At Orpea, one scandal hides another.

After the complaints of mistreatment, those of the caregivers are multiplying against the group.

Europe 1 reveals to you this Tuesday a system of fictitious CDIs, of abusive recourse to fixed-term contracts which would have become widespread in many establishments.

The Orpea group would have accumulated breaches of labor law by irregularly multiplying fixed-term contracts to replace salaried caregivers on permanent contracts, very often fictitious.

“Most of the time, the employee is either absent or does not exist,” says Léa Talrich, lawyer at the Marseille bar, who defends dozens of Orpea employees.

“We still ended up with names of family members of EHPAD directors who had never been employees of Orpea,” she explains.

Sometimes, the absent employee is "replaced by several fixed-term contracts at the same time: that is to say that there were five employees on fixed-term contracts who replaced all the same person for his absence, at the same time". 

Subsidies for unpaid wages

For what purpose did some EHPAD Orpea organize this system?

Both to manage the workforce as tightly as possible, with temporary workers who can be forced to thank you depending on the occupancy rate of the rooms, but also to generate margins on the Social Security subsidies which fully finance the nursing staff of nursing homes.

A well-organized fraud according to Léa Talrich: “They have subsidies for nursing assistant positions, for example, and in reality, they hire as replacements for ASH for less well-paid hotel service agent functions.”

"They receive subsidies for a salary which, in reality, is not paid," she explains.

All these elements are now being studied by the fact-finding mission led by the Ministry of Solidarity and Health.

The first return of the latter is scheduled for March 14.
