The Superior Court of Justice of Murcia (TSJM) considers that the regional government has not complied with the obligation to guarantee the right to receive the subject of Islamic religious education in public schools.

This is stated in a sentence in which the TSJ agrees with a woman who claims that her daughters can take the subject in this and the following courses.

The court considers that "the inactivity" of the regional popular

The ruling recalls that the 1992 law that approved the State Cooperation Agreement with the Islamic Commission of Spain establishes that "in order to give effect to the provisions of article 27.3 of the Constitution [...] students are guaranteed Muslims, their parents and the school government bodies that request it, the exercise of the right of the former to receive Islamic religious education in public educational centers".

The sentence, appealable before the Supreme Court, considers accredited "the inactivity of the Administration in completing the process initiated so that Islamic religion classes could be taught in public centers that met the legal requirements."

Therefore, the magistrates conclude that the regional administration has not respected the fundamental right to receive Islamic religious education, by not having completed the process initiated by the Islamic Commission of Spain to make this possible.
