Yesterday, the Government notified the Superior Court of Justice of Catalonia (TSJC) that it has received the sentence that requires 25% of Spanish to be taught in all Catalan schools and has pointed to the Department of Education of the Generalitat as the person responsible for executing the ruling. .

has sent this brief response to the High Court hours before the ten-day period set to comply with this procedure expired, which will allow the person responsible for non-compliance with the sentence to be identified in the event that it does not finish applying in the terms dictated by the TSJC and ratified by the Supreme Court, terms that specify that these 25% of hours in Spanish must be taught through core subjects.

By declaring itself responsible for compliance with the ruling, the Catalan Government intends to exempt the directors from assuming in the first person the consequences of a possible contempt, but the Prosecutor's Office already warned last week that "only one who is called to commit a crime of disobedience can commit comply with the judicial mandate" and the ruling of the High Court of Justice of Catalonia indicates that "the respective directors of the centers in which the issue may arise" are responsible for that compliance.

Now, the Government has a period of two months to execute the sentence, although it has already stated on several occasions its intention to circumvent it in order to maintain the monolingual system of linguistic immersion that currently governs, and has been in force for 30 years, in Catalan schools.

In fact, the Catalan Executive is orchestrating a legal framework to circumvent the ruling.

On the one hand, in January it approved an agreement guaranteeing school directors legal protection provided by the Administration to face possible responsibilities when failing to comply with the judicial requirement.

On the other hand, the Government has prepared the draft of a decree -already sent to the centers- in which they are given autonomy to decide the contents to be taught in 20% of the teaching hours, which would allow the number of hours to be extended. of Spanish in the most Catalan-speaking areas, but also dedicate them to other content and keep the immersion intact.

In parallel, this February the so-called National Pact for Language will be established, in which the pro-independence parties - with the support of the

and the PSC - aspire to shield immersion with a modification of the Education Law of Catalonia, that protects the vehicularity of Catalan as a teaching language.
