The Court of Cassation rejected this Friday a new request from the Keeper of the Seals, Eric Dupond-Moretti, to challenge the magistrates of the Court of Justice of the Republic (CJR) who indicted him for "illegal taking of interests “, according to information from a judicial source familiar with the matter.

The first presidency of the Court of Cassation rejected this request filed on January 21 and which accused the three magistrates of the CJR's investigation commission of having solicited Henri-Claude Le Gall.

This retired honorary magistrate and former president of the CJR from 2000 to 2012 would have given the procedure to follow concerning requests for nullity filed by the minister.

Asked about the reason for the rejection, the judicial source replied that the Court of Cassation had considered that the consultations of magistrates, followed or not, since they relate only to technical questions detached from the merits of the case, were simply intended to achieve a proper application of the rule of law, and therefore could not be considered as a lack of bias on the part of the magistrates, a ground for disqualification.

Éric Dupond-Moretti had already tried to challenge the magistrates in a previous request, which was rejected at the end of October.
