  • Decision Justice begins to annul fines placed in confinement after the ruling of the Constitutional Court

Vox

has announced this Monday that it is going to present a motion in all the municipalities where it has representation with the aim that the consistories issue two decrees so that the fines imposed during the

two states of alarm

decreed during the coronavirus pandemic can be returned.

Covid-19.

The formation of

Santiago Abascal

will be based on the fact that both states of alarm -decreed on March 14, 2020 and October 26 of that same year and which lasted 6 months- were annulled by the Constitutional Court.

According to party sources, in the explanatory memorandum of the motion presented in the town halls it is argued that both sentences, where the maximum interpreter of the Magna Carta partially upheld two appeals of unconstitutionality presented by Vox, "it follows that the majority of the fines imposed during the time of confinement are null and void".

That is why "they generate that the consistories decree their return either ex officio or at the request of the interested party in order not to harm the rights of those affected and neither does it generate unfair enrichment in favor of the municipalities."

Locate those affected

The motion promoted by Vox also urges that the treasury or municipal intervention investigate which people were fined during the states of alarm of the pandemic and once they are located, inform them personally, and proceed ex officio to request specific documentation. -Copy of the fine, proof of payment and certificate of bank ownership, to proceed with the return of the amounts paid for the fine.

According to data from the

Ministry of the Interior

provided in March, when a year had passed since the first state of alarm, from March 14 to June 21, 2020, 1,142,127 fines were imposed throughout Spain, while in the second state of alarm alarm the figure was 220,296 sanctions.
