A young Gulf man turned a rare classic car into a wreck after he received it from its owner for the purpose of painting it for 1500 dirhams, but he embezzled its contents and wrote it off completely.

The partial civil court of Ras Al Khaimah ordered him to pay the owner of the vehicle 78,000 dirhams in compensation for the material and moral damage he inflicted on him as a result of losing his car.

In detail, the case papers stated that the owner of a classic rare car gave his car in March of last year to the defendant for the purpose of dyeing it and handing him 1500 dirhams of the paint, but he initially embezzled the contents of the vehicle, which is estimated at 25,000 dirhams.

She explained that the defendant informed him that the car was in the garage for the purpose of dyeing and it was found that he completely squandered it, and he was convicted by the Penal Court in Ras Al Khaimah of embezzling the contents of the car and was fined 5000 dirhams, and the defendant did not appeal the ruling, which became final.

She added that the plaintiff sustained material and moral damages as a result of the defendant's act, for he lost 73,700 dirhams, the market value of his car, and paid the paint fee of 1,500 dirhams, and the purchase of dye materials at a value of 2,100 dirhams, and the value of decorating the car at 5,000 dirhams, in addition to moral damages of 5,000 dirhams. Psychological pains lasted for several months as a result of his search for his car in vain, and it was sad for him to squander it after he was bragging about it while it was of interest to his friends and family. The plaintiff demanded to obligate the defendant to pay him 78,600 dirhams in compensation for the material and moral damages he sustained along with the legal interest.

She stated that the defendant requested a settlement with the plaintiff, as the judge supervising the case in the case management office decided to assign an expert to inspect the condition of the car, as the report stated that the car was completely stripped of all its contents and internal components with the spread of rust in its chassis, engine and the rest of its metal parts Its technical condition makes it unfit for operation and use, and its market value at the time of its delivery to the defendant is equivalent to 75 thousand dirhams, and the value of its wreckage is 5000 dirhams.

The expert explained that the process of repairing the car is futile, and the car is in a state of complete destruction and total loss (written off).

The defendant stated that the car is in the workshop and changing the paint requires dismantling all its internal and external items, and as a result of canceling the workshop's license, he distributed the cars he had to several garages.

The court ruling stated that the plaintiff is legally entitled to compensation for the value of his car that was written off at a value of 75,000 dirhams, provided that the wreckage of the car is transferred to the defendant in possession and possession.

She explained that the plaintiff suffered psychological pain as a result of losing his car after he had hoped to re-paint it in a distinctive color and continue to use it. The plaintiff shall pay the delayed interest at the rate of 6% annually, provided that it is effective from the date of the judgment becoming due until full payment and obligating him to pay fees, expenses and attorney fees.

The Ras Al Khaimah Court awarded 78,000 dirhams in compensation to the owner of the vehicle.
