The plaintiff maintained the ownership of her car with official documents and paid installments for it, while the defendant decided that she was the actual owner of the car, but the plaintiff refused to transfer her ownership to her, and requested that the decisive oath be given to the plaintiff regarding the ownership of the car.

In the text of the partial civil court ruling, it was stated in the papers that the car license belonged to the plaintiff, despite it having been in the possession of her mother for a while, which confirms that the defendant received the car for the purpose of benefiting from it and not with the intention of owning it in the face of the gift from the plaintiff, because if she had taken it as a pure gift Her ownership was transferred, and the plaintiff retained the ownership of her car according to an official document in her name, and accordingly, directing the decisive oath to the plaintiff to prove that the ownership of the car was out of her hand and giving it up for the benefit of the defendant is arbitrary, and the defendant seeks to expropriate its owner and ward off the protection prescribed by law for this property, and accordingly the court prevents the defendant from taking the decisive oath due to the apparent arbitrariness of its directive.

The court indicated that it was found that the defendant committed traffic violations in the vehicle owned by the plaintiff, which she possesses, from March until last October, at 9,600 dirhams, and the court obliges her to pay the amount to the plaintiff, and accordingly the court orders the defendant to hand over the plaintiff's car owned by her, and to pay her value Traffic violations, with fees and expenses obligatory.
