Our reporter Wang Jinghuai and Liu Weizhen

The highly anticipated "Personal Information Protection Law of the People's Republic of China" has been in place for a month. Is our personal information still "naked"?

The reporter's survey found that phenomena such as leaks of house purchase information, excessive collection of information by apps, and video platforms asking for member photos are still around us.

Many experts believe that my country's protection of personal information is constantly improving, but it is difficult for privacy leakage to "slam the brakes" in a short period of time. There is still a long way to go to further protect personal information.

Personal information is still "naked"

Since mid-November, the reporter has received calls from three different decoration companies in a row. The other party called out the reporter's last name and asked if decoration is needed.

During the call, the other party reported the location of the new house that the reporter bought some time ago, and one of them even knew the house type.

"How do you know my information?" the reporter asked.

"The company is only responsible for letting me contact customers, and the others are not clear." The other party said.

The "Personal Information Protection Law of the People's Republic of China" has been implemented for one month, but the reporter's investigation found that similar personal information leaks still occur from time to time.

According to data from the National Mobile Internet Application Security Management Center, since November 1st, 44 apps have been found to be non-compliant with privacy regulations. Among them, there are many popular apps that have been installed more than tens of millions of times, such as Multipoint and Amazon Shopping.

"Privacy non-compliance refers to the act of providing personal information to a third party without anonymization, without expressly indicating to the user all the privacy permissions applied for, and collecting personal information before obtaining the user's consent." National Computer Virus Emergency Response Center The relevant person in charge explained.

The "killing familiarity" of big data that people hate has not disappeared.

A few days ago, the reporter tried to order the same three cups of milk tea with different mobile phones at the same time and on the same platform and found that the cost of the mobile phone that has not been ordered is 6 yuan lower than that of the mobile phone that has been ordered several times.

In the consumer service platform Black Cat complaints, complaints involving personal information leakage have been numerous since November: mobile phone numbers were leaked and sent out by express delivery, a certain platform received 4 overseas loan fraud calls within half an hour after granting credit, and never registered. The app sends quota text messages, merchants secretly use personal information to swipe orders, video platforms request personal photos of members, and so on.

What is "reliance without fear"?

In order to protect the privacy of citizens, my country has continuously improved its legal system in recent years. The "Civil Code of the People's Republic of China" and the "Network Security Law of the People's Republic of China" and other laws clarify the legal protection of personal information.

As a special legislation for the protection of personal information, the "Personal Information Protection Law of the People's Republic of China", which has been in existence for more than a month, is even more highly expected.

Why are there still many online and offline platforms that are confident about it?

-Illegal inertia cannot be changed overnight.

Zuo Xiaodong, vice president of the China Academy of Information Security, who participated in the drafting of a number of personal information protection regulations, believes that some illegal companies have already tasted the sweetness of building business lines or even directly selling personal information by collecting and using personal information in violation of laws and regulations. Under the development logic of China, companies will not take the initiative to "revolutionize themselves."

Chen Xuhui, director of the Internet Information and User Behavior Research Center of the Business School of Tianjin University of Finance and Economics, said that the user privacy agreements of some apps are still "formal." , Which makes it difficult for many users to understand accurately, causing "default" consent, and laying a hidden danger for personal information leakage.

-There are still ambiguities in the law enforcement process.

The reporter's survey found that from the user's point of view, it is difficult for many users to determine the necessary and sensitive information, leaving an opportunity for the App to unscrupulously collect user privacy beyond the limit.

From an enterprise perspective, Chen Xuhui said that some cooperative enterprises have data interconnection needs, but their data sharing is usually carried out in a business closed loop. Whether these data have been processed for compliance and desensitization is often not perceivable by the public, and it is easy for the supervisory authority. Supervising implementation brings difficulties.

-Laws and regulations still need to be refined.

Zuo Xiaodong believes that although my country has made great progress in legislation in areas such as the protection of personal information, compared with the fast-growing Internet industry, there is still a need to further refine laws and regulations in terms of data collection, processing, and flow. It is the protection of personal information by public institutions that needs to be strengthened so that the law can play a greater role in protecting personal privacy.

Need to work together from multiple angles

The implementation of the "Personal Information Protection Law of the People's Republic of China" not only highlights my country's firm determination to strictly control violations of personal privacy, but also a solemn statement on the protection of personal information.

Many experts said that it is difficult for some illegal acts to "slam the brakes" in a short period of time. There is still a long way to go to further protect personal information, and it is necessary to coordinate efforts from multiple angles.

First of all, industry enterprises should be guided to form an atmosphere for personal information protection.

Experts such as Sun Xuan, associate professor of the Zhou Enlai School of Government of Nankai University, said that some developed countries have clear attitudes on the issue of personal information protection and greater enforcement of law enforcement, which has made the whole society form an industry consciousness that actively protects personal privacy. This kind of personal information protection cultural atmosphere It is worth learning from my country's supervisory units and enterprises.

At the same time, starting from key links such as standardizing the application market, promote enterprises to carry out compliance reforms.

Chen Xuhui suggested that relevant departments can promote the App to establish a clear list before the user privacy agreement, like the article "Summary", clearly point out which user information is collected and its purpose, and then the details and exit mechanism will be explained in detail in the main text to facilitate users quickly Read and understand.

"The regulatory authorities can seize the key point of the mobile phone'application market', strengthen their legal responsibilities, and promote the control of apps from the source."

In addition, we will further strengthen the popularization of legal science and enhance the awareness of personal information protection.

Many experts have called for law enforcement to be the best law popularization. A batch of typical cases can be reported in the near future. While raising public awareness of the law, it also serves as a deterrent to criminals who steal personal information.
