in Spain, while in Italy the sentence for the exclusive custody of the minors is still pending in the civil process opened for this matter.

This has been pointed out to Europa Press by sources in the defense of Juana Rivas, who have shown their satisfaction with this decision. The civil process opened in Italy, which was seen for sentencing last Friday, November 19 at the Cagliari Court of Appeal, occurs after in 2019 the Italian justice granted exclusive custody to Arcuri, establishing a visitation regime that it allowed the mother to spend time with them in Spain.

The First Civil Section of the Court of Cagliari granted custody to the father "with exclusive exercise of parental responsibility and residence in the parental home".

According to this resolution, which was appealed by Rivas, giving rise to the current process, he would have to pay 300 euros per month, 150 euros per child, as maintenance, in addition to assuming 50% of the extraordinary expenses previously agreed and documented .

The minors could each year spend the period between the end of school and the first half of August close to their mother in Spain, as well as the Christmas holidays alternated with their father, according to the sentence, which was explained in this section on how the visitation regime should be carried out in the different periods.

In Spain, the Government granted a partial pardon to Juana Rivas on November 16, so, in addition to reducing her prison sentence for child abduction by half, it commuted the penalty of special disqualification for the exercise of parental authority. with respect to her children for the penalty of 180 days of work for the benefit of the community, provided that she does not commit the same crime for which she was convicted within four years.

In this context, the Criminal Court 1 of Granada received the official communication of the pardon, after which it proceeded to annul the penalty of deprivation of parental authority to which it had been sentenced for six years, thus complying with this measure of grace that was published in the BOE last Wednesday.
