A few years ago, after Li Lin gave his only real estate to his wife, the family atmosphere changed: his wife’s attitude went from bad to worse. At first, she was indifferent to the elderly Li Lin. Later, verbal abuse became commonplace. Later, the wife began to fist. Plus... Li Lin, who is over seventy years old, not only can't experience the warmth of home, but often bruises all over his body.

  On August 1 this year, when his wife made another big fight, Li Lin called the police.

The public security organs fixed the relevant evidence, and Li Lin subsequently applied to the court for a personal safety protection order.

Subsequently, the Qingyang District People's Court of Chengdu ruled that Li Lin's wife was prohibited from committing domestic violence against him.

  "For a long time in the past, people often regarded domestic violence as a'family ugly' that should not be publicized. "In Sichuan, people call a husband who has a gentle personality and loves his wives as'earning ears'. In most cases, Gandang'earning ears' reflects the tolerance of men and helps maintain family harmony. But there are also a few women. Treat the'ear rake' as weak and deceptive, inflicting mental, verbal and even physical violence."

  In 2017, among the ten typical anti-domestic violence cases issued by the Supreme People’s Court, there was a case in which a male victim applied for a personal safety protection order: the applicant Wang returned to Shanghai after retiring in 1995, and his wife Wan not only occupied Wang's pension also forced Wang to continue working outside.

In 2015, Wang, who was over 80, had lost his ability to work. Not only did Wan not take care of him, he often punched and kicked him, and often insulted him. The elderly Wang had suffered from starvation, hunger, and cold for a long time.

In the end, the People's Court of Changning District of Shanghai ruled that the woman Wan Mou was prohibited from committing domestic violence against the applicant Wang Mou.

  Although the law provides a sword for combating domestic violence, for ordinary people, there are still many cognitive barriers that need to be broken through to correctly understand domestic violence.

  In March of this year, a husband who was domestically abused applied for a personal safety protection order to the People’s Court of Shenzhen Bao’an District, which triggered heated discussions among netizens. Ridicule.

  "For a long time, people have had a stereotype that men are the natural perpetrators of domestic violence. The society is also full of prejudices that men being bullied by women are'promising', and seeking help is even more'humiliating'." Sichuan University Law School Associate Professor Wang Youliang said, “As far as domestic violence is concerned, there are only victims and perpetrators. Regardless of men and women, anyone who encounters domestic violence and seeks legal help should receive the understanding and support of the society.”

  For a long time in the past, when talking about victims of domestic violence, people often only thought of women.

Xinhua Daily Telegraph reporter noticed that in 2019, when Hunan Province formulated the "Anti-Domestic Violence Law" implementation measures, "should men be included in the subject of protection" became one of the focus topics.

The first review of the draft implementation measures proposed that women’s federations at all levels should “provide services and support for victims and protect women’s legitimate rights and interests”. This subsequently triggered a discussion about “women’s federations for lesbians and who should male compatriots look for”.

In the second review draft, the section was changed to "provide services and support for victims", which was finally approved.

  Nowadays, with the implementation of the "Anti-Domestic Violence Law", more and more men apply for personal safety protection orders to the courts. "Men also suffer from domestic violence" is no longer a new thing.

  It should be noted that although there is no shortage of male victims of domestic violence, judging from the data of judicial cases, the probability of women suffering from domestic violence is still much higher than that of men.

Take Chengdu as an example. Since the implementation of the “Anti-Domestic Violence Law”, as of the end of 2020, Chengdu courts have received a total of 262 applications for personal safety protection orders, of which 60 applications have been withdrawn, 70 applications have been rejected due to insufficient evidence and other reasons. 132 personal safety protection orders were made.

Since the beginning of this year, the Chengdu court has ruled 41 personal safety protection orders.

  In these cases, more than 90% of the applicants were women, most of which involved beatings, restrictions on personal freedom and accompanied by abuse, threats, harassment and other physical and mental double violations.

  "Anti-domestic violence work still has a long way to go and requires the joint efforts of all departments." said Zang Yong, president of the Juvenile Family Tribunal of the Chengdu Intermediate People's Court.

Since the beginning of this year, Chengdu Court has established a one-stop anti-domestic violence working mechanism with Chengdu Public Security Bureau and Chengdu Women’s Federation, established a large anti-domestic violence database, shared data and information, and strengthened follow-up visits to domestic violence cases.

  In response to the difficulties in identifying domestic violence and differences in staff awareness, the three units also jointly produced a "Domestic Violence Case Risk Assessment Form" as a reference basis for assessing domestic violence and its severity.

On November 10, Chengdu's one-stop citizen service platform "Tianfu Citizen Cloud" App opened a domestic violence acceptance port, and victims can apply for a personal safety protection order online.

  On November 23, the judge of the Qingyang District People's Court of Chengdu dialed Li Lin's phone again to inquire about the current situation.

He said that since the court issued a personal safety protection order, his wife has stopped beating herself, and now the two are in peace and continue to live together.
