According to the verdict, the 16-year-old is said to have raped the 13-year-old girl next to a bathing place in Kristianstad on June 4 this year.

The evidence against the boy consists of a mobile phone film and DNA traces found on the girl's clothes.

"Offensive situation"

Even though there was no question of completed intercourse or there was violence or direct coercion, Kristianstad District Court has found that the girl was in a vulnerable and abusive situation.

The girl has felt pressured to participate in a sexual act where as many as six boys observed the incident, several of whom participated in the act.

In addition, the assault was filmed by the 16-year-old's friend.

The film, which is child pornographic because the girl is under 15, was found by the police on the comrade's phone.

The police could also see that the film was shared via the comrade's account on social media.

Denies crime

According to the district court's assessment, the girl has told about her experiences in a very credible and reliable way.

Her story has appeared to be self-perceived and her information is supported by the rest of the evidence.

The 16-year-old is sentenced for rape of a child to 150 hours of youth service and to pay damages of SEK 115,000 to the girl.

The 16-year-old's peer is sentenced to 40 hours of youth service and damages of SEK 15,000.

Both boys have denied the crime.
