01 December 2021 Eitan, the child who survived the Mottarone tragedy, will return to Italy with his paternal aunt Aya Biran on 3 December with a flight from Tel Aviv, after the sentence of the Israeli Supreme Court in recent days which rejected the appeal of his maternal grandfather Shmuel Peleg. 



The six-year-old will return to live in the villa on the outskirts of Pavia with his uncles and cousins. The return takes place a few days after the decision of the Israeli judges who, based on the Hague Convention, held that the child's stable residence is Italy, thus putting an end to the dispute with the maternal family living in Tel Aviv. An arrest warrant from the Pavia prosecutor for kidnapping hangs on his maternal grandfather Shmuel Peleg.



The case


The Eitan case erupts on 11 September when, after the Mottarone tragedy, the maternal grandfather kidnaps the child with a rental car, reaching Lugano, and then embarking on a private flight to Tel Aviv. The prosecutor of Pavia starts the investigation for "kidnapping" against the grandfather and maternal grandmother. A dispute begins for the custody of the little one between the two family branches of his parents.



On October 17, the Italian aunt Aya goes to Israel and asks that Eitan can "return home", five days later the trial in Israel begins to decide whether Eitan should return to Italy or stay with her maternal grandparents. In the meantime, the first decision establishes that, pending the final sentence, it remains in shared management: 3 days in turn with the grandfather and the aunt. The second hearing begins which lasts three days. The judges listen to witnesses and experts: on October 12 the Prosecutor of the Canton of Ticino opens an investigation, a place of passage for the flight to Israel. On 25 October the Tel Aviv judge decides that the child must return to Italy. The grandfather appeals against the sentence.



Two days ago the Supreme Court of Tel Aviv, confirming the two decisions of the last weeks of first and second instance, recognized, accepting the request of paternal aunt Aya Biran, legal guardian of the 6-year-old child, the international abduction of the child by of the maternal grandfather on whom an international arrest warrant hangs for the charges of kidnapping, abduction and detention of a minor abroad and misappropriation of the child's passport.   



In the investigation, conducted by the Pavese Mobile Squad and by the adjunct Mario Venditti and by the prosecutor Valentina De Stefano, meanwhile, the alleged accomplice of his grandfather, Gabriel Alon Abutbul, blocked in Cyprus, where he resides, has already been arrested with a European arrest warrant. , and recently released from prison with the obligation to sign pending the conclusion of the extradition procedure.



Maternal grandmother Esther Cohen was also investigated in the Pavia investigation. From what has been learned, the maternal grandparents have already been granted the opportunity to see and greet the baby before he leaves.



The paternal family now intends to safeguard the child's privacy and interest as much as possible.

Meanwhile, the proceeding on the complaint by the lawyers of the grandparents against the appointment of Aya as guardian with a series of questions posed by the lawyers is underway before the Juvenile Court of Milan.

In recent months, the paternal aunt has already submitted a request to the judges for adoption.
