A few months after the trial at first instance before the Marseille Criminal Court, Jean-Noël and Alexandre Guérini are again called to the bar.

This Monday, this sprawling affair of alleged public procurement rigging is once again examined by the Aix-en-Provence Court of Appeal, at the request of the two brothers.

What is the Guérini affair?

Chairman of the General Council of Bouches-du-Rhône from 1998 to 2015, Jean-Noël Guérini is accused of having preempted a piece of land under the pretext of saving a rare plant, then of having sold it to a community of agglomeration to favor his brother who needed it for the extension of a landfill.

Alexandre Guérini is accused of having used his brother's position to put pressure on elected officials or officials to bypass public procurement procedures, get rich, eliminate competitors or favor relatives.

What was the decision of the Marseille Criminal Court?

"The responsibility of a man who assumes elective office is to show himself worthy of it and never to allow personal interests to take precedence over the general interest", had criticized the president of the correctional court of Marseille Céline Ballerini at the judgment statement last spring. The court then sentenced Jean-Noël Guérini to three years in prison, including 18 months suspended, 30,000 euros fine and five years of deprivation of civil and civil rights, and therefore, theoretically, ineligibility.

For his part, Alexandre Guérini had been sentenced to six years in prison, with a deferred deposit warrant.

He was also banned from running a business for five years and was deprived of his civic rights during the same period.

Both appealed against this decision, resulting in this new trial scheduled until December 17.

Is Jean-Noël Guérini still a senator?

On September 6, following the conviction by the Marseille Criminal Court of Jean-Noël Guérini, the Minister of Justice Eric Dupond-Moretti seized the Constitutional Council in order to withdraw the politician's mandate as senator.

A request rejected one week before the appeal trial of Jean-Noël Guérini, due to the lack of a final conviction of the parliamentarian.

In other words, despite his heavy sentence on May 28, and pending his appeal trial, Jean-Noël Guérini could remain senator for Bouches-du-Rhône.

A mandate that runs until 2026.
