The Supreme Procurator recently issued the "No. 7 Prosecutorial Proposal" to the State Post Bureau and sent copies to 12 relevant departments such as the Ministry of Transport and the Ministry of Commerce to promote the strengthening of the departments. "In recent years, my country’s postal express delivery industry has developed rapidly. The express delivery business volume has risen from 2.34 billion pieces in 2010 to 83.36 billion pieces in 2020, an increase of nearly 35 times, with an average annual growth rate of 43%. The current average daily express business volume exceeds 300 million pieces." According to Jin Jinghua, Director of the Market Supervision Department of the State Post Bureau, because the delivery channels have the characteristics of multiple lines, wide coverage, separation of people and goods, and strong concealment, "Internet + delivery" is easy to be used by criminals to engage in trafficking. Illegal and criminal activities such as drugs, guns and explosives, wild animals and their products.
What is worthy of vigilance is that in recent years, while drug-related crimes have declined to a certain extent, related crimes committed through delivery channels have risen against the trend.
Yuan Ming, director of the Second Prosecutor's Office of the Supreme People's Procuratorate, told reporters that there are a wide variety of prohibited items, including drugs, guns, ammunition and explosives, precious and endangered wild animals and their products, counterfeit and shoddy goods, counterfeit medicines, and counterfeit money.
Among the relevant cases handled by the procuratorial organs, there are a large number of cases involving the delivery of drugs, guns, ammunition and explosives.
It is understood that the number of prosecutions for the delivery of drug-related crimes increased from 1,016, 1,911 in 2017 to 1,830, and 3,097 in 2020; the number of prosecutions for the delivery of wild animals and their products rose from 45 to 67 in 2017. There are 490 people in 226 cases in 2020.
“Criminal cases involving the delivery of contraband are more difficult to investigate. Criminals often use code words for single-line contact, even using foreign chat software or niche communication software that burns after reading to communicate, and then use third-party payment platforms or even virtual currencies to pay for drug money. . In the process of sending and receiving, hiring others to collect, post or forward to avoid the blow." Yuan Ming said.
While fighting crimes, the Supreme People’s Procuratorate conducted a comprehensive investigation and analysis of the crime of sending contrabands and the safety supervision of delivery, and concluded that there is still a mismatch between the delivery safety supervision capabilities and the development of the industry, the new format of delivery, there are regulatory blind spots, and delivery safety supervision. The intensity needs to be strengthened urgently, the delivery safety system is not in place, the safety awareness and response ability of the delivery personnel are insufficient, and the "No. 7 Inspection Recommendation" was issued to the State Post Bureau accordingly.
In fact, in recent years, in order to promote the strengthening of the safety supervision of postal delivery, the State Post Bureau has promoted the implementation of the amendment of the Postal Law, the promulgation and implementation of the interim regulations on express delivery, and included the safety of delivery into the scope of the anti-terrorism law management, and issued the postal safety supervision and management measures, Administrative measures for real-name receipt and delivery of express mail and other departmental regulations and more than 20 industry standards.
How to take the implementation of the "No. 7 procuratorial recommendation" as an opportunity to further enhance the ability to prevent and control delivery security?
Jin Jinghua said: "We will increase the application of video networking and security inspection machine networking in business processing sites, and use modern technology to enhance safety supervision capabilities. We will implement the three systems of real-name receipt and delivery, receipt and post inspection, and machine security inspection. . Improve the supervision system that combines daily supervision, corporate self-discipline, and administrative punishment.” At the same time, the State Post Bureau will also strictly enforce safe access to express delivery business licenses, strengthen source governance, and improve industry credit management systems and market exit mechanisms.
Yuanming stated that the procuratorial organ will continue to strengthen communication and coordination with relevant departments of postal administration, transportation, commerce, etc., establish a normalized liaison and linkage mechanism, actively promote information sharing and business exchanges, and bring new forms of delivery into the scope of supervision and improvement in a timely and effective manner.
