Extend maternity leave in many places and add paternity leave for males

During the vacation of both men and women, government agencies, enterprises, institutions, social organizations and other organizations shall not dismiss them, terminate their labor or employment contracts with them, and their wages shall not be lowered; if the law provides otherwise, those provisions shall prevail.

With the consent of the agency, enterprise, public institution, social organization, and other organizations, the woman can add another one to three months of vacation.

  In Zhejiang, for couples who meet the requirements of laws and regulations to give birth to children, on the basis of enjoying state-regulated maternity leave, the wife will extend the maternity leave for one child by 60 days, totaling 158 days, and for the second and third child by 90 days, totaling 188 days.

Zhejiang emphasized that the maternity leave does not affect promotion, wage adjustments, and calculation of length of service; employers can give other preferential treatments based on specific conditions.

  On September 29 this year, Jiangxi passed the newly revised "Regulations on Population and Family Planning in Jiangxi Province," which added 90 days to 188 days of maternity leave, 30 days of nursing leave and 15 days of male paternity leave.

  Jiangsu Province passed the newly revised "Regulations on Population and Family Planning of Jiangsu Province" on September 29, 2021, and also adjusted the original maternity leave and paternity leave policies, setting a lower limit for extending maternity leave.

Jiangsu stipulates that on the basis of maternity leave prescribed by the state, the woman shall extend the maternity leave "not less than 30 days", and the man shall enjoy the nursing leave "not less than 15 days".

  In addition, Shaanxi’s draft amendments to the Family Planning Regulations also clearly give more maternity leave to mothers with three children: female employees who give birth to three children will be given an additional half-year incentive leave, and their spouses will be given an additional 15 days of nursing leave.

  Shaanxi plans to stipulate that before a female employee reaches the age of one year old, her unit shall guarantee breastfeeding time and provide breastfeeding conditions in strict accordance with the State Council’s "Special Provisions on Labor Protection for Female Employees".
