An (Arab) wife filed a divorce lawsuit in the Personal Status Court in Sharjah, from her (Arab) husband, because she is afraid that she will not establish the limits of God and hate life with him, in exchange for her giving up her deferred dowry and the maintenance and waiting period, and the court ruled in her favor to annul the marriage contract in exchange for her forfeiting her dowry The one who is deferred, the maintenance of the waiting period, the pleasure, and all her marital rights, and that she has the legal waiting period from the coming of the ruling, and he is not entitled to return her to his infallibility and his marriage contract except with a new contract and dowry, and I ordered her to count her legal waiting period according to her condition.

The court also ruled to obligate the husband to pay 200 dirhams per month of maintenance for each of his two children, provided that the alimony includes all aspects of legal alimony, including treatment except for housing, with the claimant’s entitlement to custody of them. He is obligated to pay 12,000 dirhams annually for the rent of a nursery house, including electricity, water, gas and internet bills, and he is obligated to pay 200 dirhams per month for nursery fees for two young children, and he is obligated to pay all school expenses.

The plaintiff's attorney stated before the court that her client did not reach an agreement with the husband in the family guidance, because of his stubbornness and his refusal to divorce her unjustly, pointing out that her client requests the annulment of the marriage contract in exchange for giving up all her rights.

While the husband's attorney stated that her client refused to divorce him and the plaintiff, and that he adhered to her as a wife and mother to his children, and demanded that the lawsuit be rejected.

The merits of the Personal Status Court ruling stated that the plaintiff had waived before the court the delayed dowry and all her marital rights in exchange for khul’, and the defendant had refused to divorce her since she submitted the case and demanded that the case be rejected. It is considered intransigence on the part of the husband in divorce.

She explained that the fifth paragraph of Article 110 of the Personal Status Law provided for an exception to the provisions of the first clause of this article if the refusal on the part of the husband was obstinacy and fear that they would not meet the limits of God. Therefore, the court considers the plaintiff's eligibility to request divorce.

She added that the defendant did not file an appeal against the plaintiff's custody of her two children and did not challenge her eligibility for custody of them, so the court considers that it is in the interest of the two children to stay with their mother, and about the plaintiff's request for alimony for the two young ones, as it is established in the papers that the plaintiff works for a salary of 500 dirhams per month, meaning that he is poor, Accordingly, the court considers the plaintiff’s eligibility to request alimony for the two young children, and regarding the plaintiff’s request to provide a foster home, the court considers that she does not have a home of her own, and that the defendant no longer has a home to nurse her two children with water, electricity, gas and the Internet, and accordingly the court decides the plaintiff’s eligibility for this request.

She pointed out that the plaintiff's request for a nursery fee, it is established in the papers that the plaintiff does not meet any expenses from the defendant, and accordingly the plaintiff deserves a nursery fee, in addition to the plaintiff's entitlement to study expenses for her two children, as the law requires the father to look into the affairs of the minors, such as education and treatment.
