Special ETA, the dictatorship of terror
Unsolved murders The victims sue 11 ETA leaders for the murder of a Supreme Court judge in 2000
With total clarity, the current president of the
Provincial Court of Madrid
and former examining magistrate of the National Court,
Juan Pablo González
, assured that ETA has committed crimes against humanity since its birth. "He carried out an ethnic cleansing in the
Basque Country
.
"
"There were many thousands, perhaps even hundreds of thousands of Basques who had to leave the Basque Country, significantly altering the electoral roll itself and the political and social evolution of an autonomous community."
González was the author of the first and until now the only indictment against ETA leaders for crimes against humanity. And he has participated in a round table held on Thursday in
EL MUNDO
and organized by the
Luis Portero Foundation
and the
Dignity and Justice Association
on crimes against humanity.
The day began with a few words from the director of EL MUNDO,
Francisco Rosell
, who stressed that from the newspaper "we have always wanted the voice of the victims not to be forgotten." He recalled the figure of the murdered Luis Portero, the chief prosecutor of Andalusia, in the fight for human rights. "Luis was not killed for being an individual but for what he defended: democratic values and the law." And he alerted the media: "We cannot in any case fall into a crime of leso forgetfulness, which is already taking place." "ETA is having a final victory as a consequence of its political agreements, it is achieving its commitments at the expense of those who died." "THE WORLD is always the home of the victims," he concluded.
Judge Juan Pablo González explained why he considers that there is still impunity in ETA's actions: "There are more than 350 crimes that have not been clarified, they are in the most absolute impunity. But there is also another impunity: moral, political and social."
He explained that in 2015 he reactivated in the National Court an old complaint filed by the Luis Portero Foundation against ETA for genocide and crimes against humanity.
He managed to carry out an indictment for crimes against humanity against ETA leaders who have been paralyzed in the criminal court for almost six years pending trial.
"It was the first time that ETA crimes were classified as crimes against humanity. It was a true violence of persecution, of widespread and systematic attacks against a sector of the population. The victims were chosen in consideration of being members of the subjected groups to persecution for politics and ideology ".
"These are crimes not only against life but against the international community."
He denounced that his investigation suffered many obstacles and that there was no collaboration on the part of the French judicial authorities, who did not attend the letters rogatory, including the last one, on
Josu Ternera
.
"After almost six years the much-needed trial against ETA leaders for crimes against humanity has not been held."
"An ethnic cleansing was carried out in the Basque Country. Many thousands, perhaps even hundreds of thousands of Basques had to leave the Basque Country, significantly altering the electoral roll itself and the political and social evolution of an autonomous community "he added.
"And all this with political and social impunity."
The magistrate denounced that this situation has caused that "the hegemony of nationalism in the Basque Country has been accepted as inevitable and those who did the most to end the terror have been condemned to irrelevance."
"The slogan that ETA has been defeated is an organized political lie that does not correspond to reality. It continues to exist under another name, with other methods. But it continues to act. It is essential that a story be configured on the crimes against humanity committed by ETA. In Spain, a Nuremberg trial on ETA's crimes against humanity would have been necessary, condemning its totalitarian ideology. "
It was the lawyer
Miguel Ángel Rodríguez
who put a dose of optimism before the next legal proceedings against ETA.
Rodríguez is the lawyer for Dignity and Justice who has taken these actions on crimes against humanity and who also directs the complaint against ETA leaders for the murder of magistrate
Querol Lombardero
.
"ETA has managed to expel between 60,000 and 200,000 human beings from the Basque Country. It is an inordinate violence. In the concept of international law there is no doubt that ETA complies to be considered the author of crimes against humanity, because these crimes are not They are committed by only one state, as the
Rome treaty
points out
. The United Nations human rights committee recognizes these situations. "
Move "decisively"
In a very technical intervention, Rodríguez explained why the fact of the expulsions that he carried out of up to 200,000 Basques is a crime against humanity. He assured that this situation has no parallel with any member state of the
European Union
. "The message that ETA was sending to these citizens was very clear so that they left": either with them, or out, or dead.
"ETA has the departure of the lost against humanity, although it seems that not. In all the international scenes against this type of crimes, initially, with the lights in short, it seems that they are not going to get ahead. But it ends up spending time and international logic goes unpunished. We saw it with
Milosevic,
"he said hopefully.
"If we could put aside political cards, ideologies, we would all see this clearer and advance with more determination," he defended.
The lawyer recalled, as an example, ETA statements in which he made it clear after committing attacks that whoever was not with them "must leave Basque territory."
"There is only one solution left for them: to leave. Otherwise, little by little they are eliminated one by one or in a group," said ETA in one of its public writings.
Finally
Daniel Portero spoke
, president of Dignidad y Justicia, tireless instigator of all actions against ETA in court. "Now ETA is a hidden terrorist organization, but now with a more political mask like Bildu, which has committed the most serious crimes, those against humanity." He assured that ETA could not assume a sentence for crimes against humanity "because it would be discredited internationally. And that is what we are working on. There has already been an indictment in the Court for almost six years, paralyzed, despite the fact that no one has done so. appealed, not the Prosecutor's Office or the heads of ETA indicated ". Portero expressed his doubts about the date on which it can be considered that ETA's actions can be prosecuted for crimes against humanity. The hearing ruled that since 2004, since this crime was incorporated into the
Penal Code
.
"The difference is judging five ETA leaders or 50. Since the birth of ETA or since 2004 that Spain has incorporated the crime against humanity?"
And he warned that his association will carry out actions against ETA in other countries as well.
