China’s Supreme Procuratorate Issues Procuratorial Recommendations to Stop the Use of "Internet + Delivery" Crimes

To this end, China’s Supreme People’s Procuratorate issued the "No. 7 Prosecutorial Proposal" to the State Post Bureau in order to curb the trend of using delivery channels to commit illegal crimes.

  "The content of'Prosecutor's Proposal No. 7'mainly includes two parts, including problems in delivery safety supervision and suggestions for strengthening safety supervision." Chen Guoqing, deputy procurator-general of the Supreme People's Procuratorate, said when the news was released on the 25th.

  According to statistics, in 2020, Chinese prosecutors prosecuted 1,830 cases of drug delivery, 3,097 persons; prosecuted 1,071 cases of firearms, ammunition and explosives, and 1,430 persons; prosecuted 226 cases of delivery of wild animals and their products, 490 persons, showing a rapid growth trend.

  The Director of the Second Procuratorate of the Supreme People's Procuratorate Yuan Ming pointed out in light of the case handling that the number of crimes of sending and delivering contraband is not only increasing, but also causing serious harm.

He said that "Internet + delivery" has become an important form of crime. The separation of people and goods and personnel resources through logistics and delivery channels is difficult for judicial organs to investigate.

  The Supreme People’s Procuratorate issued a procuratorial proposal this time, addressing the regulatory blind spots in the new format of delivery, and the lack of awareness of safety precautions and response capabilities of delivery personnel, and proposed “clarify the scope of responsibility and strengthen the supervision of the new format of delivery” and “improve the regulatory mechanism. Suggestions such as compacting the main responsibility of the shipping company.

  "We will actively support and cooperate with the State Post Bureau and other relevant departments to do a good job in the relevant work, do a good job in the implementation of the procuratorial recommendations No. 7, effectively promote the governance of security issues in delivery, and promote the high-quality development of the postal industry in the new era." Chen Guoqing said.

  The Supreme People's Procuratorate also investigated the crimes of sending drugs, violent terrorism audio and video, guns and explosives, wild animals and their products, etc., and collected a number of typical cases.

In the typical case of the prosecutors’ lawful punishment of the crime of sending and delivering contraband published on the 25th, a defendant used a VPN to “surpass the wall” and used an overseas website to register for Telegram software, create a chat group, and publish drugs and marijuana in the group.

  Yuan Ming said that the prosecution will work with relevant departments to effectively promote the implementation of delivery safety systems such as "receipt inspection, real-name acceptance, and machine security inspection", and timely and effectively incorporate new delivery formats into the scope of supervision to improve delivery safety. The supervisory system cuts off illegal and criminal acts of sending and delivering contraband from the source.
