Opposition to people and laws

Another awaited legal battle is taking place behind the candidates for the presidential elections over the constitutionality of electoral laws, including Law No. 1 of 2021 issued by the House of Representatives, where the President of the Supreme Council of State Khaled Al-Mashri and Member of Parliament Jalal Al-Shuwaidi submitted an appeal bearing the number “1-69 BC” before the Constitutional Chamber. In the constitutionality of the law and asked their agent to stop the implementation of the law.

Al-Mashri opposes the law on the election of the president issued by the parliament, on the pretext that it violates the constitutional declaration, along with the Prime Minister of the National Unity Government, Abdel Hamid Dabaiba, who initially rejected the electoral laws and considered them "flawed" before announcing his candidacy for the elections.

Masoud Arhouma Miftah, the Libyan Military Prosecutor, had requested that the procedures for the candidacy of Saif al-Islam and Khalifa Haftar for the presidential elections be halted, referring the matter to the need for them to appear for investigation of the facts attributed to them.

important nomination

Political analyst Musa Tehosay considered that the candidacy of more than 90 candidates for the presidential elections is a normal and important matter for any democratic electoral process.

Tihusay added, "What is consistent so far is that the upcoming elections will be exceptional by all standards and full of surprises, including with regard to the controversial candidates such as Saif al-Islam Gaddafi and Khalifa Haftar, who are the most fortunate in the east and south of the country, and problems may arise between them that hinder the course of the elections, such as the dispute over the popular base that They share it."

In his statement to Al Jazeera Net, Tehusay believes that the next conflict after closing the candidacy door will be for the judiciary and electoral laws, as many personalities may be excluded, led by Saif Al-Islam Gaddafi and Haftar, while another battle will rage between the electoral law and Abdel Hamid Al-Dabaiba.

Tehusay pointed out that the most likely candidates in the event of exclusion of controversial personalities and those who are not legally accepted is Fathi Bashagha, followed by other candidates who are less likely to win the elections.

disable attempts

Professor of international law Saad Al-Aker believes that the "obstructors" who were coerced into the electoral process were expecting that the elections would be postponed, so they worked until the last moments and until now on trying to disrupt the elections and were surprised by the international and local insistence on holding the elections.

Al-Aker continued, "If they do not obtain new positions after the elections, the group that opposes the electoral process will reject the electoral process and put obstacles, as happened in 2014, led by some of the personalities who applied for the elections, who will reject the results of the poll."

Al-Aker told Al-Jazeera Net that most of these personalities - Saif Al-Islam Gaddafi, Fathi Bashagha, Khalifa Haftar and Chancellor Aqila Saleh - have a local consensus and made some international consensus, noting that the challenge is for the candidates to obtain a 50% + 1 ratio in the first round of the elections.

The reality of the elections

Political analyst Abdullah Al-Kabeer believes that the elections have become a fait accompli and will take place in accordance with the laws and dates that are not agreed upon, and the country is on the verge of a political change that will not be the beginning of a solution to the crisis.

Al-Kabeer added that "the same political parties will jump to the new scene, except for the few, and the possibility of delay still exists, but it is weak. However, the international powers may not miss this opportunity to impose the elections on time, despite the rejection."

Al-Kabeer believes that Abdul Hamid al-Dabaiba will not oppose the elections unless he is excluded from the race, and so will any other figure who is excluded from running in the elections, and most of them will not affect the progress of the process by their objection. As for the main figures, they can prevent voting in their areas of influence.

Al-Kabeer told Al-Jazeera Net that alliances will be woven in all stages of the electoral process and will begin as soon as the names of those entitled to run in the electoral race are announced.

He considered that the rejection would increase if Saif al-Islam Gaddafi and Haftar continue in the electoral race, and if one of them wins, the results will be rejected in the west of the country, and even in the east if Saif al-Qadhafi wins. Home International Sponsored.
