The Mulhouse court (Haut-Rhin) on Monday sentenced a driver to four years in prison, three of which were suspended.

The defendant had 0.85 g of alcohol per liter of blood and traces of cannabis at the time of the facts.

His car had collided with an oncoming pickup truck.

In addition to the immediate death of the passenger, the accident resulted in serious injuries to both drivers.

The prison sentence pronounced by the court was accompanied by the cancellation of the defendant's driving license and the ban on retaking it before 18 months.

The motorist will also be required to complete a Road Safety course.

Disagreement over speed

A witness and the driver of the van struck by the vehicle both spoke of the excessive speed and zigzagging of the vehicle.

“There is a technical impossibility to drive so quickly out of a roundabout, with a car that has only 70 horsepower,” said the respondent.

With the victim, he was returning from a hunting meal where he had eaten little but had drunk four glasses of wine.

"He was more than a cook, he was almost a brother to me," said the defendant.
