As Volynets emphasized, at present, the most significant instrument of state financial support for families raising children is maternal (family) capital.

At the same time, she added that when purchasing real estate with this money, parents are obliged to provide their children with shares in the ownership of a dwelling.

This obligation should be seen as an additional guarantee of ensuring and protecting the housing rights of minors, the Children's Ombudsman noted.

However, according to her, when a foreclosure is levied on a dwelling and when all family members, including minor children, are evicted, this guarantee is meaningless.

Volynets said that the presence of the owner of the children is not an obstacle to the seizure of mortgaged real estate, that is, the credit institution has the right to initiate the eviction of a minor child from a mortgage apartment.

She proposed to initiate amendments to the Federal Law "On Mortgages (Pledge of Real Estate)", as well as to Art.

446 of the Civil Procedure Code.

"In particular, to provide for the impossibility of foreclosure on the only housing acquired with the use of maternity capital, when foreclosure on it for loan debts and further eviction of family members," the text of the appeal says.

In turn, Aida Ibragimova, an employee of the office of the ombudsman for the rights of the child in the Republic of Tatarstan, in an interview with RT, explained that according to the law, a claim cannot be levied on a single dwelling, but such a ban does not apply to a mortgage apartment.

“Now often families (we proceed from the appeals that come to the address of the apparatus) say that they bought an apartment on a mortgage and, naturally, used the maternity capital funds in part of the repayment,” the specialist said.

At the same time, the expert noted that families may have a difficult life situation, for example, a divorce, in which the ability to pay off the mortgage is lost, and then the bank will take the apartment, since it is pledged.

According to her, in order to protect children, it is proposed to amend the legislation.
