Theo case: the confirmed dismissal of the police officers for "willful violence"

The alleged assailants of Théo, this young man who has become the symbol of police violence, will be tried before an assize court.

The three police officers violently arrested this young man, in February 2017, in Aulnay-sous-Bois, one of them striking him in particular with a baton in the anus.

The three officials will appear for " 

willful violence

 ".

The three police officers will not ultimately escape the assizes.

Of course, they will not be tried for rape, for lack of evidence that the main accused willfully penetrated Theo with his baton.

It is for “willful violence” that they will appear, with the aggravating circumstance being that they were committed by persons holding public authority.

The police officer who struck the baton was also dismissed for " 

violence resulting in mutilation or permanent disability

 ".

It is because Theo, 22 years old at the material time, is now disabled for life that these police officers will be tried by an assize court, competent for crimes.

No case for the fourth policeman

The three officials hoped to be referred to a criminal court for simple offenses and therefore face lighter sentences.

But justice did not follow them.

In this case, a fourth police officer, present during the arrest of Theo, benefited from a dismissal.
