Complaints have also been filed by his relatives for intentional homicide, and they are demanding the opening of a judicial investigation.

On August 4, the son of Issam El Khalfaoui, Souheil, aged 19 at the time of the events, was shot dead by a police officer during a road check in the popular district of Belle de Mai, in the city center of Marseille.
According to a police source, the young man had been checked the day after a first check during which he refused to comply and slightly hit an assistant police officer.
Also according to this police source, while he was making a new maneuver to leave, a peacekeeper used his weapon at the door and fatally hit the young man.

A version disputed by testimonies of residents gathered by the family, who wonder about the character of self-defense invoked by the police. The family is thus demanding the opening of a judicial investigation, while the IGPN investigation has still not been transmitted to the prosecutor, and the report is long overdue. “The prosecution has never contacted me since August 4, deplores Issam El Khalfaoui. Two complaints were filed on August 23 by their lawyer, Me Emmanuel Molina, for intentional homicide and failure to help anyone in danger.
Without a response by November 23, i.e. within the three-month period allowed for the public prosecutor to render his decision, Souheil's family intends to seize the dean of the examining magistrates to lodge a new complaint with the constitution of civil party. .
