November 11, 2021New hearing today in Tel Aviv on the appeal presented by Shmuel Peleg, grandfather of little Eitan, the only child who survived the Mottarone tragedy, against the first sentence that had been in favor of Aya Biran, the child's paternal aunt.

The Italian consul in Israel Emanuele Oldani will be present in the classroom as 'listener' (flanked by a translator).

The Biran family made it known, adding that the decision was taken by the court as "Italy is also a party to the Hague Convention, the country from which Eitan was kidnapped". 



Meanwhile, Shmuel Peleg makes it known that his lawyer Ronen Daliahu will address the issue of the international arrest warrant issued against him by the Pavia prosecutor. "Nobody likes to have an arrest warrant against him but he will face it", he said in an interview with Radio 103. Peleg is accused of kidnapping the child, smuggling him to Israel in early September during a visit granted to him by Aya Biran, the paternal aunt appointed as guardian after the death of Eitan's parents. 



Against the request for arrest, the grandfather's lawyers, the lawyers Paolo Sevesi and Sara Carsaniga, filed an appeal with the Milan Review Court. However, any execution may take some time. The order was examined by the Milan Public Prosecutor's Office, which forwarded the request for extradition to the Ministry of Justice, which in turn will forward "through diplomatic channels" to the Israeli Ministry of Justice. It is difficult to predict whether Israel, based on international conventions signed with the European Union as an external member, will decide to extradite Peleg.



Arrest warrant also for grandfather Peleg's accomplice, who works for the private security company BlackWater. They are accused, together with their maternal grandmother Esther Cohen, of the crimes of kidnapping, abduction and detention of minors abroad and of not having observed the provision of the tutelary judge of Pavia, which confirmed the paternal aunt Aya Biran legal guardian of the little. 



Lawyer Peleg, "child not examined by any expert"


Eitan "to date has not been examined by any expert" in Israel, Ronen Dlayahu points out.
