Abu Dhabi Court decided to dismiss the case

A woman accuses a man of stealing 90,000 dirhams for her car

The Abu Dhabi Court of First Instance rejected a lawsuit filed by a woman demanding that a man pay her 90,000 dirhams, the price of her car that a buyer had brought for her. And she demanded to oblige a man to pay her the amount of 90,000 dirhams and the legal interest at 12% from the date of filing the case until full payment, and to oblige him to pay expenses and fees and in return for attorney's fees, noting that she owned a Range Rover and offered it for sale, so the defendant submitted and decided that he would undertake the sale The car, then brought a buyer, and after the defendant promised that he was personally obligated to hand her the price of the car, she gave it to someone else, after which he turned off his phone.

In the lawsuit papers, the woman attached a photo of car ownership and correspondence photos, and submitted a memorandum requesting the introduction of a new discount, and requesting that he be obligated with the defendant jointly to pay the amount claimed.

The court confirmed in the merits of the ruling, that it is stipulated in the first article of the Evidence Act, that the plaintiff must prove his right and the defendant has to deny it, and it was decided that the court was not obligated to conduct an investigation that was not requested by the litigants, noting that the plaintiff decided that she had relinquished the car in question. At the Traffic and Licensing Department, the papers were empty of evidence that the defendant had not paid the price of the car, while her relinquishing the car to the competent authorities was a presumption that she had received the price.

She added that the plaintiff did not request an investigation on this subject, and then the court decided to reject the case in her case, and the court ruled to reject the case, and asked to be entered in her case, and obligated her to expenses, fees, and in exchange for attorneys' fees.
