A (Gulf) wife filed for a tort divorce before the Personal Status Court in Fujairah, due to the husband's health problems that prevent him from having a natural child, and he must resort to the IVF technique.
In detail, a wife has filed a divorce lawsuit demanding the return of her psychological rights that she was subjected to during her marriage, and her divorce because of her husband's inability to have children except through tubes that require treatment for long periods and several attempts that exhaust her physical and psychological energy.
In the lawsuit papers, she asserted that she had a strong desire to have children in a natural way without the trouble of undergoing treatment and having to take medications to help her get pregnant, which might affect her health in the future, noting that the doctors diagnosed her husband as unable to have children in natural ways and suffering from health problems that prevent him from doing so.
She indicated that she was not living a stable married life as a result of being indirectly affected by these reasons, which made her unable to bear living with the husband in one dwelling, demanding her to divorce her until her psychological stability.
On the other hand, the husband told the court that throughout the marriage he did not fail his wife in all the aspects required of him in marital life, whether material, psychological and other, but his wife insists that he is deficient and deficient due to his inability to have children in natural ways, stressing that all their attempts to have children in natural ways were not It succeeded, which forced them to see a doctor who proved that his wife could get pregnant without the need for treatment, which prompted him to perform some medical examinations that revealed his inability to have children naturally or through medication, but he had to resort to the IVF technique.
He pointed out that the idea of his inability to have children in the natural way, is something that God has decreed for him, stressing that he consulted more than one specialized doctor to be able to solve his problem, and all of them agreed that he could not give birth to a healthy child free of problems and deformities except through test-tube babies.
For its part, the Personal Status Court rejected the divorce claim for the damage, because the wife did not prove the actual harm inflicted on her.
