The Orange company was condemned for "hidden work" by the correctional appeals chamber of Riom (Puy-de-Dôme).

In its judgment delivered on Wednesday, the court ordered the company to pay a fine of 50,000 euros.

The telephone operator had however been released at first instance in Clermont-Ferrand (Puy-de-Dôme).

The practices alleged against the group took place between 2013 and 2016.

During this period, four employees of a subcontractor "were assigned exclusively to the performance of tasks on the sites or buildings of the company Orange in Auvergne", estimated the court.

Integration in the facts but not on paper

The persons concerned thus did not experience the same advantages as if they had been employees of the company.

For several years, the technicians were nevertheless found "under the subordination of Orange, integrated in fact to this company", found the appeals chamber.

In addition to this legal procedure, the case was also brought before the industrial tribunal.
