82.4 thousand dirhams in compensation to the owner of a stolen vehicle

The Abu Dhabi Court for Family and Civil and Administrative Claims ordered two young men to pay the other 82,400 dirhams, as compensation for the material and moral damages that resulted from the first stealing the plaintiff’s car, and the damages caused to the second defendant.

In detail, a young man filed a lawsuit, in which he demanded to compel two young men to pay him 187,000 dirhams, in compensation for the material and moral damages he sustained as a result of their stealing and damaging his vehicle.

He pointed out that the first defendant stole his Mercedes E model 2017, and the second defendant purchased the stolen vehicle from him without transferring its ownership, and used it recklessly that led to significant damage to it, and the two defendants were convicted of charges of theft, possession and destruction.

The report of the engineering expert delegated by the court showed that the plaintiff repaired all the faults caused by the defendants, at an amount of 32 thousand and 400 dirhams, indicating that the market value of the vehicle was estimated before the theft at 125,000 dirhams, and the vehicle was repaired, and thus the car maintained its market value before Theft and damage.

The court clarified in the merits of its ruling that the evidence from the papers that the cause of the damage to the vehicle was the fault of the first defendant who stole it, and the fault of the second defendant who damaged it as established by the penal ruling.

The court indicated that the expert’s report confirmed that the plaintiff’s vehicle had suffered many damages, and that the latter had repaired the damages caused by the two defendants. The court must oblige the defendants to pay him the amount of repair specified by the expert.

The court ruled to obligate the defendants to pay the plaintiff 82,400 dirhams in compensation for the vehicle's repair and moral damages.
