In the details, an employee filed a lawsuit against his employer, requesting that it pay him an amount of one million and 500 thousand dirhams in compensation for the material and moral damages he sustained over two years, and obligating the defendant to pay fees and expenses and in exchange for attorneys' fees.

He indicated that he worked for the defendant as a manager for 21 years, and he was suspended without justification, and he filed a labor lawsuit against her, and a final judgment was issued in which she obligated her to pay him an amount of 572,727 dirhams, and hand him an experience certificate.

He explained that the defendant had filed criminal complaints against him in bad faith, with the intent of obstructing the labor lawsuit, and accused him of squandering cash sums handed to him by the company and its clients by way of agency.

The court decided to accept the appeal in form, and rejected it in substance, pointing out that the defendant company was not satisfied with that, but wrote a malicious communication and a ruling was issued in which the case was not allowed to be considered due to the previous decision, and the civil case was rejected, the appeal was rejected, and the appealed judgment was confirmed.

He pointed out that the defendant had filed a commercial lawsuit against him for his claim for the amount of one million and 971 thousand dirhams, and the lawsuit was rejected in the Court of First Instance and on appeal.

The plaintiff asserted that he was harmed by the defendant’s reckless and bad faith filing of lawsuits, which harmed him, and his suspension from work due to the criminal complaint of breach of trust, and the subsequent seizure of his passport and travel ban until the court acquitted the accusation and denied him the transfer of his residence to another party and obtaining a source livelihood, as the defendant received job offers, and the resulting fines were imposed for not renewing his residence permit, breach of obligations to repay the bank loan, and the tiredness of having to appoint a lawyer over two years, which required material compensation in addition to moral compensation for the depression he suffered from , while the defendant's attorney submitted and submitted a reply memorandum, in which he concluded that the case should not be considered due to the previous ruling on it by partial labor judgment, and that the case was rejected for lack of validity and substantiation.

For its part, the court clarified that the plaintiff based his claim for compensation for the damages he sustained as a result of the defendant filing a criminal complaint.
