The plaintiff explained that he had received many calls and inquiries from his fans about his participation in a series, where he saw his name and photo on the website of a television channel, and it became clear to him after opening the link that the defendant had exploited his name and artistic reputation, and used his personal photo on its website as marketing for one of the series, without His knowledge and permission or his approval to participate in the work, so I gained on his account and his reputation among the people, and caused him great embarrassment by his followers and fans, and I took advantage of his name and image to attract the largest percentage of viewers and follow-up.

The plaintiff indicated that he was subjected to moral damage, as a result of his name, fame and reputation being used to market and promote this series without his participation in it, for which compensation is due. That he contract with another at the same time, as the wage he receives for contracts ranges between 850 thousand to one million dirhams, and as a result of the defendant’s mistake in exploiting his name, he was exposed to material losses.

The plaintiff’s agent submitted a memorandum attached to a portfolio of documents, and the defendant’s agent also attended, and submitted a reply memorandum in which he indicated that the company producing the work had indicated that the plaintiff was a candidate for representation in the series, but the difference occurred before the start of filming, and the contract was not signed by the plaintiff. And that the ads for the series were shown based on the nominations, and not an exploitation of the name.

For its part, the court clarified that the plaintiff must prove his claim, and the defendant has the right to deny it.
