The teacher said that the little boy had already asked her, a short time before, to be allowed to go to the bathroom, and that she had asked him to wait another ten minutes. At that point, according to her account, it was the colleague who granted the child permission to go out: "The support teacher is also a class teacher, I didn't think of asking her to accompany the child, I saw her on the threshold of the door while she said to him: 'You can go, don't worry.' At one point we heard screams, we initially thought that someone was scolding a child. Then the other teacher came out to see, then she called me: 'Come, someone fell. 'So I went to the bathroom to get the little boy who had come out of the classroom, but he wasn't there, so I looked out and saw him. "
Also in the trial against the support teacher, defended by lawyers Michele Sarno and Valentina Lamberti, another school teacher also testified, who at the time of the accident was accompanying the children of her class to the gym. According to the investigation of the prosecutor, Maria Letizia Mocciaro, the child, who had gone out to go to the bathroom from his classroom located on the second floor of the building, would have climbed into a swivel chair to look out from the stairs, precisely because he was attracted by the shouting of the little ones who were on their way to physical education.
