Courts The Prosecutor's Office investigates as embezzlement the endorsement of the ICF demanded by the Court of Accounts of former Government officials
The Superior Prosecutor's Office of Catalonia has asked the Superior Court of Justice of Catalonia (TSJC) to reject the complaints and complaints filed by Vox, Coexistence Cívica and Ciudadanos against the president of the Generalitat, Pere Aragonès, and the councilors Jaume Ribó and Laura Vilagrà, as well as other members of the Executive, considering them "necessary cooperators" in the endorsement that the Catalan Institute of Finance (ICF) approved for the guarantee of 5.4 million euros that the Court of Accounts claims to thirty former senior officials of the Generalitat. This endorsement was rejected a few days ago by the court that executed the embargoes of the people with accounting responsibility, among whom were former presidents Carles Puigdemont and Artur Mas or ERC leader Oriol Junqueras.
Specifically, the Prosecutor's Office is holding an investigation open to determine whether the Governing Board of the Catalan Institute of Finance (ICF) committed any type of crime by guaranteeing the bail of 5.4 million euros. However, the complaints against Aragonès and other members of the Government for alleged embezzlement when granting these guarantees must be processed in the TSJC, as the defendants are measured.
At the request of the TSJC, the Public Ministry has reported that it is against investigating these complaints against the Government, considering that "the mere articulation of an endorsement mechanism that, provisionally, guarantees the precautionary requirements of a judicial or administrative procedure in the fact that an official or authority is involved does not in itself imply the cause of damage to the public patrimony or, consequently, the existence of a crime of embezzlement of public funds ".
Prosecutor Pedro Ariche points out that "the autonomous administration continues to retain control over such resources and has an executive procedure that guarantees their due return."
It remarks that the alleged embezzlement only exists if there is a "public damage" if the authorities or officials had committed "an inappropriate or disciple application" of these funds "aimed at unduly favoring people who did not meet the requirements" to obtain them as well as " elude or delay indefinitely in time the obligatory "return to the public treasury when the time comes.
