On October 23, the Thirty-first Meeting of the Standing Committee of the 13th National People's Congress passed the "Family Education Promotion Law of the People's Republic of China" (hereinafter referred to as the "Family Education Promotion Law"), which will be implemented on January 1, 2022 .
Guo Linmao, director of the Social Law Office of the Legal Work Committee of the Standing Committee of the National People's Congress, said that this law will provide more adequate and powerful legal guarantees for promoting the healthy growth and all-round development of minors.
The content and methods of family education are diverse. The Family Education Promotion Law stipulates that the content of family education mainly includes: cultivating the Chinese nation’s sense of community and family-nation sentiments, good social ethics, family virtues and personal virtues; cultivating scientific exploration and innovation consciousness , Good study habits and behavior habits, etc.
The methods of family education mainly include: strengthening parent-child companionship, giving full play to the roles of both parents, precepts and deeds, respecting differences, and equal exchanges.
"The realization of family education is iteratively upgraded from the traditional model based on family rules, family instructions, and family letters as the carrier to a new model that is guided and driven by the rule of law, with the core values of socialism as the main content, and the fundamental task of establishing morality." Guo Linmao Said that this new law has raised family education from the traditional "family affairs" of the old period to the important "national affairs" of the new era.
At present, some parents or other guardians do not have a strong sense of responsibility for the main body of family education, and there are still varying degrees of failure to raise, raise and teach minors.
The most critical subject of family education is the parents, who must teach their children the "first lesson in life".
Therefore, the Family Education Promotion Law defines family education as the nurturing, guidance and influence of parents or other guardians on minors.
Guo Linmao said that the new law clarifies that the responsibilities of parents or other guardians include: following the law of minors’ growth and establishing a correct concept of family education; they should cooperate closely with primary and secondary schools, kindergarten infant care service agencies, and communities, and actively participate in family education guidance. Parents should be separated or divorced, and they should cooperate with each other in fulfilling their family education responsibilities, and neither party should refuse or neglect to fulfill their responsibilities; entrust others to take care of minors in accordance with the law, and they should regularly understand the minor’s learning, living conditions and psychological conditions, and the relationship between the minors The client jointly fulfills the responsibility of family education and so on.
In legal liability, in addition to stipulating that parents or other guardians do not perform or incorrectly perform the legal consequences of family education responsibilities, it also stipulates that in the process of handling cases by public prosecutors and legal agencies, if a minor is found to have serious bad behavior or commit a criminal act, it shall be based on the situation. The guardian shall be admonished, and he may be ordered to receive family education and guidance.
Guo Linmao said that the main responsibility of family education lies with the family. The state does not intervene excessively, but certain support measures are needed.
The new law stipulates that the people’s government at or above the county level shall formulate special plans for family education work, include family education guidance services into the urban and rural public service system and government procurement service catalogs, and include relevant funds in the fiscal budget; the people’s governments at or above the county level determine family education guidance agencies, Organize the establishment of a professional team of family education and guidance services, carry out family education services, and provide targeted family education services to families with certain difficulties in family education, especially left-behind minors and families with distressed minors.
The new law also requires that marriage registration agencies, adoption registration agencies, child welfare agencies, and minor assistance and protection agencies of the civil affairs department should provide family education guidance in conjunction with their own work; encourage colleges and universities to open family education courses and cultivate family education professionals ; Support natural persons, legal persons and unincorporated organizations to donate or provide voluntary services for family education, and non-profit family education service institutions may be established in accordance with the law.
The new law stipulates that primary and secondary schools and kindergartens should incorporate family education guidance services into their work plans and professional training for teachers. When minor students are found to violate school discipline and school rules, they must promptly stop discipline and provide targeted family education for parents or other guardians. Guidance services, etc.
Residents’ committees and villagers’ committees may set up community parent schools or home education and guidance service sites.
