22 October 2021 The Minister of Public Administration, Renato Brunetta, presented the Guidelines for remote work in the Public Administration to the unions. The Guidelines on agile work will then be dealt with in the contracts that each sector has in place at the table of Aran.

The Guidelines outline precisely indicates the prerequisites for granting smart working as an adequate rotation of personnel authorized to perform agile work, while ensuring the prevalence for each worker of work in presence. It is therefore not possible to do agile work five days a week but must alternate it with work in the office. Furthermore, only the internet connection provided by the employer can be used and not computers and private connections.

Brunetta: smart working guidelines will anticipate contracts

"This meeting comes at the end of a process, which began on 10 March with the Pact for the innovation of public work and social cohesion signed at Palazzo Chigi, and continued with the start of the contractual renewals, which I strongly wanted, and with my decree of October 8. Today's discussion was necessary because, pending the definition of renewals and therefore of the regulation of agile work in contracts, but also of the approval by January 31 of the integrated plans of activities and organization (Piao), we think it is useful for the 32 thousand Italian administrations to be able to count on guidelines on smart working that anticipate what will be foreseen in the contracts. Guidelines on which we ask for your observations and which we will then send to the Unified Conference ".Renato Brunetta then anticipated that: "If all goes well we will make it structural". In addition, the Minister for Public Administration added: "In the meantime, I hope that the contract for the central functions and, subsequently, those for local authorities and health care, can be concluded as soon as possible at the Aran headquarters. The contractual regulation of smart working it was a cornerstone of the Pact of March 10. From the end of January we will have structured, regulated, contracted and organized out of the emergency agile work, which must fully fall within one of the ways of organizing work in the Public Administration ".In the meantime, I hope that the contract for the central functions and, subsequently, those for local authorities and health care, can be concluded as soon as possible at Aran. The contractual regulation of smart working was a fundamental point of the Pact of 10 March. In the

outline of the Guidelines

, anticipated by AdnKronos, the "conditions for access to work performance in an agile form" are indicated and it is explained that "the worker must be provided with suitable technological equipment". Furthermore, "

only the

Internet

connection

provided by the employer

can be used

to access the applications of one's own institution

". The administration must then "provide specific methods to allow the reachability of its applications remotely". Always to ensure

data

protection

, the Guidelines specify that "in no case may an employee's personal or domestic user be used for ordinary service activities". It is specified that: "Adherence to agile work has a consensual and voluntary nature and is allowed to all workers, whether they are full-time or part-time employment relationships and regardless of whether they have been hired with a permanent or fixed-term contract ". "

The administration

identifies the activities that can be carried out in agile work

, it being understood that shift work and those requiring the constant use of non-remotable equipment are excluded ". Furthermore," the administration in giving access to agile work takes care to reconcile the needs of well-being and flexibility of workers with public service improvement objectives, as well as with the specific technical needs of the activities. Without prejudice to the latter and without prejudice to the priority rights enshrined in the regulations in force from time to time and the obligation on the part of workers to guarantee adequate performance, the administration will take care to facilitate access to agile work for workers who are in conditions of particular need, not covered by other measures "." In any case, a

range of inoperability

must be identified

(disconnection) - in which the worker cannot provide any work performance. This band coincides with the 11-hour consecutive rest period referred to in art. 17, paragraph 6, of the National Collective Labor Agreement 12 February 2018 to which the worker is required ", we read again. The public administration that wants to do smart working must guarantee"

the invariance of the services provided to users

"but also"

adequate rotation of personnel authorized to perform agile work

, ensuring in any case the prevalence for each worker of work in the presence "reads again in the Guidelines presented by the Minister of Public Administration Brunetta to the trade unions. It is therefore not possible to do agile work five days a week but must alternate it with work in the office.

FLP and CSE:

new guidelines sink agile work experience

"The outline of guidelines that was presented to us today in the meeting at Palazzo Vidoni with the Minister of Public Administration Brunetta, presents very serious problems, which in the opinion of the FLP (Federation of Public Workers and Public Functions) and of the CSE (Independent Confederation of European Trade Unions) ) will determine, if adopted in the proposed formulation, the abandonment of agile work in all public administrations due to the manifest impossibility of being able to ensure all the conditions set out in the Guidelines, as well as constituting an objective problem for the repercussions that they risk having from the point of view of health security in a phase in which, unfortunately, the pandemic emergency is still present ". "In this sentence, and at least until 31 December 2021 - underline the two organizations - we should not abandon the emergency smart working, in order not to disperse the positive experiences and in order to contain the dangers of the spread of infections. President Draghi warned of the risks of a resurgence of the pandemic as happened in Great Britain. The path that we have proposed is to apply an effective gradual return to attendance, maintaining the possibility of carrying out agile work up to 50% of the staff in service in public offices, providing for the technological safety conditions for access from remote to applications. For the rest, at this stage, also with reference to the individual agreement, all the simplified measures provided for by the Law Decree 34/2020 for the performance of agile work must be maintained, provided for by the current legislation for both private and public work "." Among other things, the Minister with these guidelines - they continue - enters with a straight leg on the bargaining that is currently taking place in the Central Functions Section, with positions, among other things, still distant between the parties, establishing constraints also for all the other sectors. At the end of the meeting, the Minister asked the trade unions. to formulate observations and proposals on the outline of guidelines and updated the comparison at a forthcoming meeting to be held in early November which will have to decide on a new document prepared on the basis of the observations made.provided by the law in force for both private and public work "." CGIL: meeting with Brunetta first step for regular agile work

"Today's meeting represents a necessary first step for the regulation of agile work in the public administration system. The exit from the emergency phase must result in overcoming the many anomalies we have witnessed in recent months and which have seen many female workers and many workers operate without pauses, without protection, with their own tools. Up to now, the only barrier to the absence of rules has been collective bargaining in the workplace. it would be wrong to think of public administrations as a whole "is what was stated at the end of the confrontation between trade unions and the Minister for Public Administration Renato Brunetta, the confederal secretary of the CGIL Tania Scacchetti. "We reiterated to the Minister - continues the union manager - that we believe it is necessary to strengthen and relaunch bargaining and discussion in the Bodies and individual administrations at this stage, starting with the National Collective Labor Agreement, which is the best regulatory space for every form of work activity. , including agile work ".

CISL: on remote work well comparison, we will make proposals

Appreciation for the search for solutions that pass from bargaining, the desire to improve the guidelines with detailed proposals, willingness to continue the discussion. This is the position of the CISL regarding the meeting with the Minister of PA Renato Brunetta on remote work. The confederal secretary of the CISL, Ignazio Ganga, in charge of the Public Employment, highlighted how: "The CISL appreciated the desire to create an overall vision and therefore find solutions that necessarily pass through bargaining, especially on such a delicate matter that interests work-life balance, safeguarding frailties, the necessary respect for the right to disconnect, indispensable principle of equality of rights between workers who are engaged in agile work and those who instead ensure their work in the presence "." Some aspects, however - points out the trade unionist - do not appear well outlined in the document prepared by the technicians of Palazzo Vidoni, who do not grasp the necessary sensitivity towards the workers who, we emphasized in the intervention, often ensured with their own means and no small difficulty the maintenance of productivity and the full functioning of the public machine during the pandemic emergency. The CISL therefore asked to be able, through a more defined contribution of the federations, to arrive at shared guidelines and better articulated than those presented, and for this very reason he communicated to the minister that it will be our care to prepare a more detailed text ".

UIL: we have achieved a good result

PierPaolo Bombardieri, Secretary General of UIL commented: '' We have achieved a good result: many of our claims have been accepted.

There is still work to be done on this table with the Minister and, even more, on the bargaining table.

In these offices we will claim the necessary and further steps forward to finally define an accomplished smart working ''.
