The Prosecutor's Office abandoned this Monday the passive role that it has exercised in the investigation into the arrival in Spain of the leader of the Polisario Front

Brahim Ghali

with a concise and forceful writing in which it distances itself from the criteria of the State Lawyers.

The Public Ministry is placed in the opposite extreme by not showing itself in favor of filing the procedure as pursued by the representation of the former Minister of Foreign Affairs Arancha González Laya, investigated in the case.

Moreover, the prosecutor not only disapproves of the dismissal raised by the lawyer, but also validates the arguments of magistrate

Rafael Lasala

, who insists on the need to continue investigating the circumstances of the "peculiar" arrival of the historic Saharawi leader.

Prosecutor

Juan Pablo Fraj

challenges the appeal where the Lawyer requested the file, and he does so "in the interest of - he specifies - that the order of the appealed judge (by the Lawyers) be confirmed on its grounds". That is, he asks to ratify the document with which the instructor denied the dismissal and in which, among other things, he accused the Government of "a frontal violation" of the

Schengen

regulation

with the entry of Brahim Ghali.

The prosecutor also legitimizes the popular accusations, whom González Laya's lawyer wanted out by not recognizing them.

He considers that the channels for the characterization were correct because, he clarifies, "all the necessary requirements" were met.

Fraj also does not support the 150,000 euro bond that the Lawyers were interested in if the lawyers

Antonio Urdiales

and

Juan Carlos Navarro

continued in the procedure.

The prosecutor reacts

The lawyer has always maintained that they are not an injured party and, in fact, the former Foreign Minister refused to answer her questions when she went to testify on October 4.

Finally, the prosecutor rejects the request for sanction for the violation of secrets that the lawyer appreciated by one of the popular accusations, since he understands, he indicates, "that it does not compromise the investigation."

With this position, the Zaragoza Prosecutor's Office leaves behind its few interventions in the interrogations and its absences in many of them.

The position staged by the Public Ministry responds to the request of the Provincial Court of Zaragoza to rule on the request of the Lawyers to close the investigation.

The lawyer went directly to the Court when she learned in advance, as highlighted in her writing, the position of Judge Lasala and the null possibilities that the appeal would prosper in reform.

"These requests - he recalled in his appeal - were reiterated at the beginning of the statements made on September 13 (...) his Honor (sic) verbally anticipated that they would be dismissed and announced that any appeal that in his day was filed in this regard, which is why the present appeal is directly appealed ".

The next to declare

Before the Prosecutor's Office ruled against the criteria of the Lawyers, the popular accusation exercised by Antonio Urdiales requested the abstention of the State Attorney General, Dolores Delgado, in the already known

Ghali case

. The objective, reflected in his writing, is "to render without effect the orders or instructions that he may have given to his chief prosecutor in Zaragoza and that he abstain in the future."

External judicial elements aside, the investigation into Ghali's entry into Spain continues, now with the approval of the Public Ministry, and will be reactivated on November 29 with the former chief of staff of Carmen Calvo,

Isabel Valldecabres

, and of Fernando Grande-Marlaska,

Susana Crisóstomos

, who will sit before the magistrate as witnesses.

His appearance was scheduled for Monday, but technical problems prevented it.

Lasala cites Valldecabres after the diplomat and

number two

of González Laya,

Camilo Villarino

(also accused), assured that he called him on behalf of his boss to find out if Ghali would enter Spain two days before he landed in Zaragoza.

The call

"He calls me on the phone and says: 'Camilo, is it true that the possibility of Brahim Ghali coming to Spain is being considered?'

In those terms, as is, and all his intervention in this matter is reduced to that call, which asks him to make his boss to find out if it is true. I answer that I do not know, "he revealed.

At that moment, the magistrate intervened.

"From which Ministry was that chief of staff calling you, from Defense?"

"No, no, no," continued Villarino, "that of the first vice president of the Government."

The diplomat wanted to make it clear to the instructor that Isabel Valldecabres did not intervene again.

"Later he did not have knowledge of this matter or to be art or part (...) he called me, let's say it like that, in a personal capacity".
