As compensation for the medical error resulting from the delay of two doctors working for the hospital in diagnosing his condition, which resulted in the death of the tissues of the left testicle, which led to its removal.

In the details, a young man filed a lawsuit against a medical facility in which he demanded that it pay him the costs he incurred as a result of error and negligence during the operation to remove the testicle, and compensate for the serious material and moral damages he sustained as a result of the medical error by the defendant in the amount of three million dirhams, and oblige the defendant fees, expenses and attorney's fees.

The case was dismissed for lack of evidence, and in precaution, the case was referred to the Higher Committee for Medical Liability to examine the objections, while obligating the defendant to pay fees and expenses.

In its ruling, the court explained that the evidence from the report of the Medical Responsibility Committee is that the 27-year-old plaintiff, due to the delay in reaching the correct diagnosis with a twisting of the left testicle, led to an infarction of the testicle (tissue dies), which necessitated its removal, and that the patient (the plaintiff) was reviewed in The appropriate time was the emergency department in the hospital several times, where he visited a female doctor working in the hospital, but she did not conduct the appropriate clinical examination for this case to reach the correct diagnosis to avoid what happened to him later. There is evidence of injury to the left testicle.

The court confirmed that what is established in the papers is that the defendant has actual authority over the two doctors in supervision and direction, and this job has been prepared for them to perform that act, and then the defendant is responsible for paying compensation, and the dependency relationship exists between them, which entails her responsibility for the damage and she must perform the guarantee.

She indicated that the plaintiff did not have a disability, so she estimated compensation for the error, negligence and the removal of the left testicle, for which he is entitled to half the blood money, pointing out that the plaintiff is in the prime of his life and has not married, the court considers the plaintiff's entitlement to compensation, as a result of the psychological and physical pain he suffered, And the accompanying feeling of sadness and sorrow as a result of error and neglect in the delay in diagnosis.

• The report of the Medical Responsibility Committee clarified that the situation could have changed if an early diagnosis had been made.
