• The video of Laya before the judge: "It was a political decision"

The

State Bar

has once again seen its claims frustrated in the case in which a judge from Zaragoza investigates the entry into Spain of the leader of the Polisario

Brahim Ghali

front

.

The magistrate has refused to file the proceedings as requested by the State attorney on behalf of the former Minister

Arancha González Laya

, whom the investigator maintains as an under investigation.

In a car to which this newspaper has had access, the head of the Court of Instruction number 7 of Zaragoza,

Rafael Lasala

, insists on the need to continue with the investigation before, he says, the presence in Spain "of who in such a peculiar way entered ".

"This is not the time when a complete assessment of the fact under investigation, of the existing evidence material and of the criminally relevant participation in it of the investigated or of other people, as the case may be, has to be carried out, since the abbreviated procedure is developed according to the progressively from the initial accusation to the final conclusions, "he maintains.

In addition, the instructor stops at the judicial processes that Ghali had open in Spain (already archived) at the time he landed at the Zaragoza Military Base.

"It should not be forgotten that it is also investigated whether the conduct could have the purpose of avoiding legal problems in our country (...) because if there is knowledge of a judicial process against a person and although there are no precautionary measures against him, the authorities They must inform the competent courts of the location of the investigated subject, knowing that such investigation had been interested by the same, leaving a later assessment if, if there is a criminal qualification on such conduct, it would be a cover-up - as they seem to point out. the popular accusations- or a prevarication ", ends.

The instructor also accuses the Government of "a frontal violation" of the Schengen regulation and does so in a severe way.

"In this case it is also obvious that when a third-country national is registered as inadmissible pursuant to paragraph 1, letter d) -the SIS, Schengen Information System- the Member State authorizing him to enter its territory will inform of this to the other Member States, something that not only has not been done, but it has also been recognized that it was not intended to be done deliberately in order for the entry to be 'discreet

'

", the judge highlights.

The order, dated October 7, supposes another "clash" with the State Attorney, which already turned against the magistrate when he decided to call González Laya as investigated.

At that time, the lawyer considered the summons "impertinent" because, according to her understanding, "the result of this diligence (the accusation) is not going to provide any further clarification on the facts under investigation than the one that already works in the proceedings with the statements and other proceedings carried out ".

The former Foreign Minister appeared before the instructor on October 4 and in her statement, validated her efforts before the arrival of the historic Saharawi leader.

González Laya insisted that his department did not carry out any irregular movement and that Ghali entered the country with all the guarantees and without violating the laws.

"Everything has been done according to the law," he said.

The former minister also avoided the instructor's questions about the decision for Ghali to travel to Spain, relying on the fact that many of the questions she was asking about were secret and supported by the Law on Official State Secrets.

As he stressed, giving details could pose a danger to national security.
