  • Justice The Prosecutor's Office maintains that Juan Carlos I was an international commission agent

The

Prosecutor

's

Office

of the Supreme Court rules out again extending the investigation procedures that affect the King Emeritus. As reported by

El Confidencial

, and confirmed by tax sources to

EL MUNDO

, prosecutors are preparing to close the three investigations that affect Don Juan Carlos: the proceedings for the alleged collection of commissions from the

AVE

to

Mecca

; the inquiries for the gifts received from the Mexican billionaire Allen Sanginés-Krause, channeled by Air Force Colonel Nicolás Murga Mendoza; and the pre-trial proceedings opened for the alleged hidden fortune on the

island of Jersey

.

As this newspaper reported, December is the deadline to decide whether to close the proceedings, extend them or file a complaint or lawsuit against the monarch for these events.

The decision to opt for the dismissal, which has just been adopted by the Public Prosecutor in recent days at the highest level, will arrive in the coming weeks.

Just as the opening decrees of the investigation proceedings have been signed by the State Attorney General, Dolores Delgado, so will the archiving decree.

In it, the Prosecutor's Office will reflect the exhaustive investigation to which the monarch has been subjected in recent months with the aim of transmitting the idea that it is not a false closure of the case.

Prosecutor sources explain to EL MUNDO that the investigations have encountered several obstacles that have prevented the prosecutor from putting them in the hands of the

Second Chamber

of the Supreme Court. On the one hand, the inviolability of Juan Carlos de Borbón - he was unimpeachable while he was Head of State -, the prescription of possible crimes committed and, in addition, the fiscal regularizations carried out by the Emeritus.

In the last year, and although there are still proceedings carried out that have not been answered, the Public Ministry has not found any reinforced evidence of a crime that allows criminal action against the father of Felipe VI before the High Court.

The Supreme Prosecutor's Office suspects that the King amassed more money abroad than was regularized before the Treasury, but the handicaps that the investigation has encountered prevent him from crediting it.

Total dismissal

The investigation has been very complex and over the months different lines of action have been considered. At first, it was valued to summon the King to testify, although finally the prosecutors of the investigative team came to the conclusion that the Public Ministry was not competent to do so. Then, they studied whether it would be possible to file a complaint instead of a complaint for these events - a circumstance that was also ruled out - and, finally, they considered carrying out a reorganization of the proceedings with the prior file of those opened by the AVE to La Mecca.

Finally, everything indicates that it will be a total dismissal of the three main open lines of investigation that will come after criticism of the actions of the Prosecutor's Office has been

increasing

in recent months among prosecutors of the highest category of the Fiscal Career and magistrates of the Supreme Court, fundamentally, by the delay of the procedure.

The voices critical of Delgado's actions and the prosecutors of the team coordinated by

Juan Ignacio Campos

, with the Chief Anticorruption Prosecutor

Alejandro Luzón

, have been arguing that, almost a year after taking on the investigation into Juan Carlos de Borbón, he has not come forward. a complaint against the former head of state, but none of the open proceedings have been filed either.
