The Ras Al Khaimah Civil District Court ruled to obligate an Asian driver and an insurance company to pay a Gulf national an amount of 340,000 dirhams in compensation for the material and moral damages he sustained as a result of a traffic accident while playing sports, and obligated them to pay lawyers’ fees, and it rejected other requests.

In detail, a Khaleeji filed a lawsuit in which he demanded to oblige the defendants in solidarity between them to pay him one million dirhams, the value of appropriate compensation for the material, moral, psychological and future damages he sustained to his body and money as a result of an accident that he suffered and resulted in injuries that prevented him from moving and exercising his personal life for a long period, and what he suffered from Loss and lost gain.

The accident report stated that the driver, while driving his vehicle on the transiting Emirates Road in Ras Al Khaimah, collided from behind with the vehicle of King Al Khaleeji, driven by an Asian driver who was driving behind him and ignited the side signals to warn the vehicles.

The case papers indicated that the car that committed the accident was insured by an insurance company (the second defendant), so he demanded that they jointly compensate him for all the material and moral damages he sustained and made him immobilized for more than seven months, during which he lost his work and interests, as he suffered an injury to the left forearm and knee. The left side, swelling and pain in the right elbow, fracture of the thoracic vertebrae and spine, and bruises on the leg, hand and head.

She added that the plaintiff was sedated in the hospital in an unstable condition, and paid 48,699 dirhams of the treatment bill from his own money, and stayed for seven months in bed, and hired a nurse to perform physiotherapy for him, which cost him 3000 dirhams, the nurse's accommodation expenses.

In the ruling, the court stated that the first defendant, who caused the accident, was driving his car, and because of his thoughts and absent-mindedness, he was surprised by a vehicle moving slowly in front of him, and collided with it, for not leaving a safe distance despite using the brakes, and that what the second defendant (insurance company) reported from driving the plaintiff For the bicycle and the car behind him at a slow speed and not commensurate with the speed of the road, and it is rejected, because the case papers came empty with the benefit of officially preventing bicycles from walking on the road.

She clarified that what is established for the court is that the plaintiff's injuries do not constitute a permanent disability and that he has healed from the bone injuries and has gradually begun to improve with physiotherapy, but the injuries in themselves constitute a serious breach of the plaintiff's right to life and the integrity of his body, which is the damage in the future, with which the court appreciates the compensation For him, at a value of 120,000 dirhams, and it was proven to the court that the plaintiff lost his job for seven months, which is a damage that deserves compensation, estimated by the court at a value of 50,000 dirhams. He is also entitled to compensation for material damages that he paid from his treatment bill, at a value of 48,699 dirhams.

She stated that with regard to compensation for the plaintiff's loss of his bicycle and car, the court must compensate him in the amount of 26,513 dirhams, and for his sexual impotence and the grief caused by his health condition, he is entitled to compensation in the amount of 94,788 dirhams, compensation for moral damages, and accordingly the court decides By obligating the defendants, jointly between them, to pay the plaintiff 340,000 dirhams in compensation for the material and moral damages he sustained as a result of the accident, as well as obligating them to pay expenses and attorney fees, and all other requests were rejected.
