Covid-19: two suspended unvaccinated nurses dismissed by justice

Since September 15, the medical professions must certify that they have received at least one dose of the vaccine against Covid-19.

This Monday, September 27, the administrative court rejected the summary filed by two caregivers from the hospital of Munster in Alsace.

The couple refused to be vaccinated and were suspended without pay on September 15.

The judge did not accept the infringement of a fundamental freedom as put forward by the applicants' lawyer,

The two caregivers have both had Covid-19 and have antibodies.

They refused the vaccination and offered to be tested before each job.

According to their lawyer, the vaccination obligation violates their physical integrity and their private life.

The summary judge did not accept this argument.

The two caregivers were informed and warned several times by mail and during an interview that they risked being suspended.

He adds that caregivers provide no proof of the dangerousness of vaccines or proof of their ineffectiveness in reducing the Covid-19 epidemic.

In addition, the judge recalled a judgment of the European Court of Human Rights last spring.

The Court considered that compulsory vaccination is an acceptable interference in the privacy of European citizens when it comes to the protection of public health. 

One question remains, will this decision set a precedent?

It is still not known how many caregivers were suspended two weeks after the entry into force of the vaccination obligation.
