The new device "will be effective from January 1, 2023," said the minister.

The probationary penal warning must make it possible to "break with the evanescent character" of the reminder to the law, "penal response too weak to be effective", underlines the Minister of Justice.

The end of recalls to the law, an alternative measure to prosecution, had been voted in May by the deputies within the framework of the bill "for the confidence in the judicial institution".

Reminders to the law gradually abandoned

Pending the entry into force of the probationary penal warning, reminders of the law will also be gradually abandoned for certain types of offenses.

In 2019, 260,000 reminders of the law had been issued, or 21% of the criminal response.

The law "for the confidence in the judicial institution" will be examined in the Senate in first reading from Tuesday.
