In addition, the Valencia Court makes it clear that, according to its criteria, in the tests carried out "there is not a complete or sufficient answer either in the autopsy reports" or in those sent by the

National Institute of Toxicology and Forensic Sciences

on this relative question. to the substance of the toad bufo.

That is why he asks the court to carry out these procedures, which will further lengthen the judicial procedure.

The magistrates also upheld the appeal of Abad's relatives regarding the exoneration of Vidal's cousin and his employee who were present at the time of the ritual. They consider that by having to carry out more tests until the results of the tests, it cannot be determined whether the two committed an alleged crime of homicide through gross negligence or another of concealment or omission of the duty to help. The Civil Guard report indicates that there is a delay in the emergency call and that the video from the security cameras shows the two defendants removing elements used in the rite.

Regarding the imputation of the actor's cousin, the Valencia Court remarks that the court exonerates her despite seeing "signs of criminality" in her conduct since she was a "clear connoisseur of the practice in which José Luis Abad died; of the neurological effects produced by the inhalation of the substance; it is who lends itself to be the contact with who supplies the substance and who assists in its development ".

A dismal ritual

The court of Xàtiva will have to re-practice various proceedings on this matter. In his resolution a few months ago, he concluded that Vidal, allegedly, "began the preparation of the potion, without having any control of the dose as the pipette was not calibrated or using any weighing instrument" regarding the dose of "toad poison. bufo "and that he administered it in a glass pipe. That is why he believes that "the amount that is inhaled can be controlled, because it is a fact that the inhalation by José Luis caused his fainting and subsequent death", since Vidal also consumed something to accompany the photographer.

In addition, it highlights that the photographer warned the actor's cousin that a few days before he had consumed "5 or 6 beers and 5 or 6 lines of cocaine." The ritual was carried out in an "open field, unpaved, located on the right side of the stables" of Vidal's house in Enguera "pretending to create false stimuli" in Abad with a handkerchief on the ground, a cushion, bells, a Tibetan drum and bowl. There the victim "voluntarily" inhaled the vapors produced by the combustion of the substance, through the pipette he had in his mouth, always directed "at all times and supervised" by the actor.

It was after taking this substance that "immediately and almost surprisingly" the photographer collapsed to the ground abruptly and began to suffer convulsions, in addition to a "numbness of the chest and head with a visibly purple / bluish tone" and the slow contortion of the extremities, all accompanied "by a continuous sob / moan, which undoubtedly showed that something was not right". However, Vidal continued with the ceremonial practice since, according to what he declared, it was a normal reaction when taking the toad and only stopped when the victim was still unconscious, trembling and with breathing difficulties.

The Xàtiva judge indicated that, after requesting medical help and while waiting for the ambulance, the actor began to perform "an incorrect and brief resuscitation maneuver" on the photographer and even threw water in his face and turned him "face down, which did not facilitate the recovery of breathing at all ".

The

died shortly after a cardiorespiratory arrest from an "adverse reaction to drugs of abuse," according to the autopsy.
