The Balearic Justice

endorses the massive confinement of students

who were on an end-of-year trip in Mallorca three months after that notorious and controversial measure adopted by the Balearic Government at the end of June.



The

Superior Court of Justice of the Balearic Islands

(TSJB) has reviewed the process and concludes that the regional Executive acted correctly,

in a "well-founded" and "proportionate" manner

in a situation in which, according to the ruling, "it had no alternative."



The magistrates contradict and thus amend a lower court judge who annulled that detention of students suspected of having been infected with Covid and authorized the free mobility of all those who had given negative in the tests.



The magistrate then had the

support of the Prosecutor's Office

. They considered that the Government did not sufficiently justify the massive confinement in the famous Bellver hotel in Palma, which became the epicenter of protests between accusations of "kidnapping" of minors. Among other things, the judge and the prosecutor argued, because the close contacts of each person confined with Covid positives were not individually detailed.



For days an intense controversy raged.

The study trips to Mallorca triggered the first big outbreak of the summer, and the largest to date

. And the Government wanted to establish a firewall and confined all study travelers from Mallorca. A measure that polarized public opinion and rebelled against the parents of many of the boys, who filed a massive complaint claiming that they had been illegally detained and that they had been made to pay for the positive of other travelers who had previously traveled to the Island. .



Now, in

a decision inane and without practical effect

because it

comes months after the controversy, the highest court of the Islands gives reason to the Executive headed by

Francina Armengol. Mainly, because it

considers that it acted according to the law and based on epidemiological reports

of the National Center for Health Emergencies. The magistrates emphasize in their sentence that the judges, including themselves, do not have epidemiological knowledge. A clear message to the judge who released them.



The great practical consequence that this sentence will have is that it pays the

foreseeable exoneration of the general director of Public Health

of the Balearic Islands, Maria Antònia Font, who was charged with a series of complaints filed by some of the complaining parents. Although it is a different procedure, it will be difficult for a complaint to prosper with such a forceful pronouncement from the TSJB on the matter. In fact, and according to sources in the judicial environment of Palma, the Prosecutor's Office, which opposed the formal execution of that confinement, does not see a crime instead.
