In the ruling, the court stated that it is legally prescribed by the Civil Transactions Law regarding the plaintiff’s first request to oblige the defendant to pay her an amount of 174,000 dirhams. The defendant made a clear and explicit declaration that he had received 174,000 dirhams from the plaintiff, and that he was preoccupied with this amount for the benefit of the plaintiff.

The court indicated that the plaintiff’s request to oblige the defendant to pay her the delayed interest at the rate of 12% from the date of filing the lawsuit until the date of payment, it is decided that the interest is a penalty for the debtor’s delay in repaying the debt, despite its maturity, not being considered as usury that is prohibited by Sharia and law. It is compensation for presumed damage as a result of the debtor’s procrastination, which cannot be proven otherwise, whether the obligation is civil or commercial, pointing out that the plaintiff’s request for interest is based on a factual and legal basis, which the court orders to oblige the defendant to pay the plaintiff the delayed interest.

The court ruled, obligating the defendant to pay the plaintiff an amount of 174 thousand dirhams (one hundred and seventy-four thousand dirhams), and obligating the defendant to pay the plaintiff the delayed interest at the rate of 5% of the amount ruled from the date of filing the lawsuit until full payment, and obligating him to pay the lawsuit fees and expenses.
