15 thousand dirhams in compensation for a woman who was beaten by her ex-husband

The Abu Dhabi Court of First Instance ruled that a man must pay 15,000 dirhams in compensation to his ex-wife for the physical and psychological damage she sustained as a result of the beating and her injury with scratches and bruises in the face and arms.

In the details, a woman filed a lawsuit against her ex-husband, asking for 150,000 dirhams in material and moral compensation, noting that he had assaulted her, and a criminal judgment was issued against him convicting him and a fine of 10,000 dirhams.

During the consideration of the case, the woman's lawyer presented a portfolio of documents that included a photocopy of a medical report showing that the plaintiff had superficial scratches on the face and a bruise on the left forearm, right arm and legs, and that the general condition was stable unless any complications occurred, in addition to a receipt issued by the plaintiff's attorney's office stating Receiving an amount of 50 thousand dirhams for the civil lawsuit as fees, while the defendant’s attorney submitted a memorandum in which he ended up rejecting the lawsuit for lack of validity and proof and for it being free of any damages to the plaintiff, and attached to it the judgment issued in the personal status lawsuit between the two parties, and the judge divorced the plaintiff from her husband an irrevocable divorce Minor damage. The court stated, in the merits of the judgment, that the defendant's mistake was established in the text of the penal judgment issued against him, as he caused the plaintiff bodily harm represented in the damages she sustained as a result of the assault on her by the defendant as evidenced by the medical report, noting that the assault did not cause the plaintiff any disability or impairment.

She pointed out that the plaintiff's claim for financial compensation as a result of the follow-up cost her in the partial civil case in the amount of 50 thousand dirhams, the court considers that the amount shared by the plaintiff with the lawyer indicates her generosity and does not reflect the actual material losses to her, and that the bruises and scratches she suffered, in addition To the moral and psychological damage that has befallen her and the feelings of sadness, grief and heartbreak that befell her due to what the defendant has done, which is what the court considers an estimate of compensation for all those damages.

And it ruled obligating the defendant to pay the plaintiff 15,000 dirhams, and the legal interest at 5% until the date of its becoming final, with obligating him to pay fees and expenses.
