04 September 2021 To close the second day of the Ambrosetti Forum in Cernobbio was the Minister of Justice, Marta Cartabia, with an eagerly awaited speech on the reform.

Investing instead of paying the costs of the disservice

"Investing in justice is not at no cost, it is good to do it to improve the service rather than pay the damages of the disservice". Marta Cartabia cited the case of appeals to the Pinto law to which citizens who have encountered trials that went beyond a reasonable duration: "well", explained the minister, "the requests for reimbursements and compensation are increasing. ".

"In the last 5 years the State has spent 573 million euros", while "the cases involved are 95,412. These requests for reimbursements - he added - create paradoxes because they further clog the courts and increase disputes, so we have delays and costs at the square; it looks like a puzzle, but the situation is serious. " "If these resources had been earmarked for the improvement of justice, we would all have benefited from them."

Reform is courageous, realistic, unanimous

By the end of this year, the enabling laws must be approved both for the reform of the civil trial and for that of the criminal trial; subsequently, in the first quarter of 2022 "we need to hire the first young jurists for the trial office". "In five years we must have reduced the disposition time of the duration of the civil trial by 40% and for the final trial by 25%", recalled Cartabia, according to whom "effective choices are needed that significantly intervene on the problems even if they can be perceived. how uncomfortable ".

"You can't be worried about chasing consensus, you need a long look. You need to be aware of the real problems and their complexity: these ambitious goals must be achieved".

"The journey of the reforms in some cases is very turbulent. The pilot is required to have steady nerves and great willingness to listen, to mediate, to seek shared choices. The reform of justice will not be done in a sudden but in small steps".

Italy observed special

"We are observed special in international circles on the reform of justice. There is a lot of anticipation." "On justice, the status quo is not an option, we cannot stand still"

We do not start from the prescription

'' The issue of the prescription '' is not central, the prescription is '' an extreme remedy for exceptional situations, it is not the problem from which start''.

Reform supported by resources and means

"I do not feel pessimistic, I am animated by realistic optimism: these reforms, perhaps for the first time, can count on resources, funding, personnel and means". "The goals of that challenging time-cutting goal are backed up by the right equipment." According to the minister, "the reform of the civil and criminal trial are being approved and the parliamentary calendars tell us that they should be completed in September". Our society, Cartabia concluded, "needs to learn how to resolve conflicts".

Magistrates eager to improve the service

"When I meet the magistrates, I meet people who are eager, and most of them carry out their task with great dedication, to be put in a position to improve the service they offer to citizens". For Cartabia it is necessary to intervene, in order to improve the timing of the trials, with a "tailored" approach, that is, with tailor-made interventions for individual judicial offices that are afflicted by different problems.

"Italian justice is not all the same. There are some very virtuous situations and others more in difficulty. I began to visit the Court of Appeal for the Court of Appeal, also to understand the specific problems in person. In short, a tailored approach is needed. ", he said. "We need to intervene at those levels. And there I find no resistance".

16,500 jurists to form teams in support of judges

"The problems of the times of justice must be solved above all with organizational measures". The Minister of Justice Marta Cartabia, at the Ambrosetti Forum observed that the judge often works alone and must take care of all the work. With the justice reform, Cartabia said, "we want to give him a team, a team to help him organize his work. The funds of the PNRR, intended for the recruitment of 16,500 jurists and 5,400 administrative helpers, are used precisely for this. open, if you know jurists spread the word ", he concluded.
