The Dubai Court of Appeals convicted two brothers who assaulted a (Gulf) student with excessive violence because of the “Playstation” game, and caused him to suffer partial blindness and a permanent disability of 35%. Six months' imprisonment.


The victim, a 20-year-old student, said that he was playing with a PlayStation, a popular game among teenagers known as “Call of Duty” against another student, and while playing the other player mocked him for no reason because he beat him, and then called him He insulted him, but he did not respond and hung up.


He added that he received a call on the third day from (the first accused), the brother of the student with whom he was playing “PlayStation”, and inquired of him about the problem, and he told him what happened, so the caller insisted on meeting him to resolve the dispute, but the victim student refused, and then received a call from the brother of Another, (the second accused), spoke to him in a friendly manner and insisted on meeting him to clear the atmosphere and solve the problem, so he responded and agreed to meet him because of his urgency to do so.


The victim indicated that he went on the agreed date to the parking lots of a school in the Al-Mizhar area, accompanied by two of his friends, then the two brothers of the accused who was playing with him attended, so he spoke to them and asked them to stop calling and disturbing him, and went to his vehicle, but before reaching it, he was surprised Several vehicles entered the parking lot and more than 20 people got off. The two accused brothers went towards him, in addition to a third fugitive, and beat him in different parts of his body. One of them hit him with an instrument in his right eye, so he fell to the ground. His friend was taken to the hospital and reported the incident at Al Qusais Police Station.


The forensic report revealed that the injury to the victim's eye was caused by a direct assault, and will leave a permanent disability represented in the loss of vision in the right eye, which constitutes a disability of 35%.


For its part, the Criminal Court in the first instances of litigation sentenced the two brothers to a year in prison, but the two defendants appealed before the Court of Appeal and their lawyer asked to hear the defense witnesses, including a person who stated in his testimony that the victim came to the scene and a verbal altercation broke out with the accused, then a group gathered on the first Of the people, not including the two brothers, then the victim left in his friend's car.


The witness added that the friend returned after a while in his car and told them that he had assaulted the victim and taken him to the hospital, denying that the accused had a role in the assault suffered by the victim, and another witness supported him in that.


The defendants' lawyer argued that the victim's statements were incorrect and contradicted by the testimonies of the prosecution witnesses.


After examining the case, the Court of Appeal stated in the merits of the ruling, its conviction that the victim was playing with the accused’s brother and mocked him, which angered the latter, so he insulted him with obscene words, then incited him by his two brothers, who lured him to the scene of the incident and beat him with another fugitive, causing him to suffer a permanent disability. Confirming her conviction of the conviction of the accused, but decided to reduce the penalty from one year to six months.
