The Public Prosecutor shall determine by a decision issued by him, in agreement with the public representatives in the local judicial authorities, misdemeanors and violations to which the provisions of the penal order are applied, and the Public Prosecutors, each within his jurisdiction, shall issue the decisions necessary to implement the provisions of this article.


The criminal order is issued to whoever is proven to have committed the crime, by imposing the legally prescribed fine on him, and not exceeding half of its maximum limit, in addition to complementary penalties and fees, and the civil right claim does not prevent the issuance of the penal order, and the civil claimant may resort to the competent civil court to claim his rights, The ruling on the subject of the criminal case is not valid before the civil courts, and the punishment issued by the penal order is not considered a judicial precedent that requires rehabilitation.
