■ What is the difference between a complaint and a report, and when does each occur?

■■ The complaint occurs in crimes that may not be moved or accepted except at the request of the concerned parties, and the legislator organized its provisions in the Federal Penal Procedures Law No. 35 of 1992, as it stipulated in its tenth article, that the criminal case may not be filed in the following crimes except Based on a written or oral complaint from the victim or his legal representative:


theft, fraud, breach of trust, and concealment of items obtained from them, if the victim was the offender's spouse, or one of his ascendants or descendants, and these things were not judicially or administratively seized or encumbered by the right of another person.

Looking at the type of crimes related to the complaint, we find that they are crimes in which the private right prevails over the public right, or the existence of social and moral considerations that may be waived in any case in which the lawsuit is.


As for the notification, it is to inform the competent authorities about the occurrence of a crime, and it is the right of any person against whom a crime has been committed, witnessed or knew of its occurrence.
