The declarations of the Minister of the Presidency, Félix Bolaños, on the form of election of the CGPJ have provoked the reaction of the judicial associations.

They are "alarming and irresponsible," according to the statement from the

Francisco de Vitoria Judicial Association

, second in representation.

Bolaños rejected that part of the 20 members of the Council be elected directly by the judges, as claimed by the associations.

That is not possible, according to Bolaños, because in a "full democracy" like the Spanish one, "neither the judges can choose the judges, nor the politicians can choose the politicians."

Francisco de Vitoria "regrets that the new minister is unaware that the European Commission and the Council of Europe have been demanding Spain for almost eight years to change the system of election of the CGPJ so that the governing body of the Spanish judges does not depend solely and exclusively from political parties ".

"It is surprising and regrettable", continues the association, "that the minister of an EU member state says publicly that the European institutions themselves have been asking that same country for eight years to do something that is not fully democratic, which is alarming severity. "

According to the association's spokesperson,

Jorge Fernández Vaquero

, "it is difficult to understand that someone who supposedly believes in judicial independence and the separation of powers can defend a CGPJ election system like the current one if it is not because they take advantage of the partisan duopoly in the one that the PSOE and PP have converted it, but to say that it is not democratic to try to correct this anomaly is alarming irresponsibility and ignorance and even more so when it is said by no less than the same minister that the Government has commissioned to solve such an important problem and urgent: with these proposals from Bolaños, the situation of the CGPJ can only get worse. "

The association has published another message with screenshots of tweets that both the PSOE and Pedro Sánchez made in December 2014 in which they called for the depoliticization of the CGPJ.

"The minister says that what his party and the current president were rightly proposing about the #CGPJ when the European Union began to demand from Spain what the minister now calls undemocratic is not democratic," he stressed.

For its part, the Catalan section of the Professional Association of the Magistracy (APM), the majority in the race, spread this message on the networks in response to Bolaños' statements: "Unfortunately they continue to conceive the CGPJ as a cake that they cannot leave to be divided ".

Also the PP

The association uses the plural because the criticisms include the PP, which kept the system in power by which the 20 members of the CGPJ must pass through the filter of the Cortes.

In his extensive statement, Francisco de Vitoria expressly mentions the PP.

"The minister also ignores that this is what all the judicial associations in our country have been claiming for years, which already in 2014 joined together to demand that the Rajoy government depoliticize that system, which the PP did not do when it could do so and Nor in recent years with the current leadership, which during this same legislature has been on the verge several times of distributing it again with the PSOE ".
